About Dianne

Dianne Marx is a trial lawyer with extensive experience in a wide variety of business law and civil matters. She has the experience of having participated in some 40 jury trials of civil matters in both federal and state courts, as well as representing clients in numerous court trials and hearings. Dianne loves the courtroom and brings the passion with her to every case that she takes on.

Although Dianne has successfully represented defendants in jury trials, she has also represented plaintiffs in complex civil cases that have resulted in verdicts and settlements in excess of $2 million.

She has experience in the following areas:
Commercial and business litigation
Disputes involving wills and trusts on behalf of families and fiduciaries
Fraudulent transfers and schemes to defraud investors
Employment relations and contract termination
Personal injury litigation and malpractice issues

With over 30 years of experience representing publicly-traded companies, family owned businesses as well as individuals, Dianne fights for her clients, yet also knows that due to the cost and emotional toll litigation can take, creative settlements through alternative dispute resolution and mediation should be considered. Consistent with this, Dianne is a trained mediator and her work includes mediation in state court. In 2014, she recieved the distinction of being a "Woman of Influence" by the YWCA and in 2015, she was honored with the Montgomery Co. Common Pleas Court Mediation Service Award.

As Past President of the Dayton Bar Association, Dayton Bar Foundation, and Greater Dayton Volunteer Lawyers Project, as well as a past chair of the Artemis Center for Domestic Violence, Dianne is actively involved in the legal community and frequently co-counsels with other attorneys on behalf of their clients.

Dianne received her law degree in 1982 from the University of Notre Dame School of Law, where she was a Thomas J. and Alberta White Scholar on Law and Public Policy.

Cases

US Diamond & Gold Jewelers v. Julius Klein Diamonds

Description: Plaintiff claimed it shipped a 5.56 carat, natural fancy intense pink diamond, valued at a wholesale price of between $1.5 and $2million to Defendant, an International Diamond Trading Company Sightholder. Defendant claimed through testimony and their in store video that Plaintiff had shipped an empty box to them and engaged in an insurance scam. Plaintiff had no photograph of the diamond shipped nor record of the pink diamond ever being placed in his inventory. In fact, other than the testimony of the Plaintiff, there was no evidence of the pink diamond being purchased or shipped to Julius Klein Diamonds. Outcome: After a three week trial, the jury awarded $6.9 million to Plainitff and attorney fees.
