Please describe a case in the last year or two where you made a big difference.
I represented a client in a large gang indictment case during the first part of 2015. My client's exposure was approximately 70 years in state prison. By devoting all my energy and time to the case, I was able to get a complete dismissal for my client. While I was litigating the case, I filed a motion and the Court ended up dismissing not only twenty (20) strike offenses for my client, but also over 200 strikes charged against the co-defendants in the case. Co-counsel thanked me for getting rid of the charges for their clients.
How did you build a successful practice?
Customer service is key to my successful practice. I make sure to explain the criminal process to all potential clients. I inform everyone of how hard I work, but at the same time ask clients to maintain reasonable expectations. I am always up-front and honest with clients. I am also always available by email, phone or text and am glad to discuss anything with a client. I am also always prepared when dealing with judges and prosecutors, and when representing my client's interests in court. That kind of preparation leads to better than average results - but it also requires a lot of time and dedication.
What should clients look for in a lawyer?
Not all cases are the same. Clients should ask themselves what kind of lawyer they need for a particular case. Do you just need someone to appear for you in court and plead you out? Do you need someone who will spend as much time as necessary and fully investigate every fact and possible defense? Do you have lots of questions and want an attorney who will answer them for you? It all depends on the client. Ultimately, clients should look for someone they can trust. Client should seek out someone whose advice and counsel (which they are paying for) they will ultimately listen to and follow.
How important is local knowledge to the success of your cases?
The California Penal Code is the same in all counties - but the criminal justice system is not. My knowledge of the Santa Clara County criminal justice system is one of the most important and useful tools that I bring to the table. I am able to better advise clients, sometimes push harder, sometimes ease off, and seek out custody alternative programs and other resources that an attorney from out-of-county may not even know about. It makes an incredible difference to know the Judges that you are appearing in front of. It is also important to know the prosecutors - what they're like, what they're interested in, what makes them tick. Timing is crucial in the criminal process - and avoiding all the pitfalls from filing deadlines, to scheduling issues - is only possible because I have a lot of experience in handling numerous cases in this county. Other attorneys sometimes come to me to ask questions about local issues.
What information can you provide in a free phone consultation?
I have tried doing free phone consultations, but usually those don't leave me with enough time to actually help the client. I offer a paid consultation now. I review the entire case file or any documents you'd like to provide me, and meet with you by Zoom to provide a detailed explanation of the Court process, as well as an evaluation of the merits of your case. I also provide a strategy for how we can move forward to achieve your goals, and explain why or how an attorney can help you, or whether you need an attorney at all. It takes up to an hour.
