STATE v SANTOS

Attorney for the Appellant (Defendant) in an Appeals case in which said Appellant  appealed from the judgment of the trial court revoking his probation and reinstating six years of the executed portion of a previous sentence for armed robbery. Five years after his initial conviction, said Appellant was arrested on a sexual assault charge. Although he was found not guilty because of reasonable doubt at trial, his was provoked by using the lesser standard of proof of a preponderance of the evidence. He challenged the court's conclusion that the evidence was sufficient to establish that he committed sexual assault in the first degree. The Appeals court affirmed the original Trial decision.

SAKSENA V. COMM'R OF CORR.

Appellant: Attorney for the appellant, Sharad Saksena. Saksens was appealing a judgment handed down from the habeas court which denied his petition for a writ of habeas corpus. The appellant alleges that the court erred when it concluded that the counsel did not render ineffective assistance by failing to advise him about the immigration consequences of his guilty plea. Upon review of the case and the representation that Saksena received, the appeals court found no err in judgment had occurred. The decision of the habeas court was affirmed.
