State vs. B.W.
CHARGE: Possession of a pistol without a permit. SUMMARY: Our client was charged with having a pistol without a permit in a public place after his wife called the police. The pistol was found in a locked storage area in an apartment building. We filed a motion to suppress the gun, because the police did not have a warrant. We also asserted marital privilege so that the client’s wife could not testify against him. CASE DISPOSITION: The gun was excluded and the wife’s testimony was not allowed. This left the prosecutor with no choice but to dismiss the case.
State vs. T.G.
CHARGE: Driving while under the influence. SUMMARY: Client was pulled over for DWI and the breath test machine was malfunctioning. The police then asked if she would take a urine test. Because of recent developments in caselaw, police need a warrant for urine tests. We filed a motion to suppress the test because the police did not inform her that refusal to take a urine test is not a crime without a warrant. CASE DISPOSITION: The Court agreed with our position and suppressed the test result. We were able to have our client plead to a speeding violation.
State vs. S.G.
CHARGE: Domestic Assault (Harm), Domestic Assault (Fear), Disorderly Conduct. SUMMARY: Client was accused by his mother of Domestic Assault. Client vehemently denied the accusations, and at Nickell Law Firm we always had a strong belief in his innocence. We fought with the prosecutor and received very good offers that would have eventually resulted in dismissal of the case. Nevertheless, our client had faith in our abilities at trial, and asserted his right to a trial by Jury. We were able to vigorously cross examine the State’s witnesses, poking enormous holes in their stories. Our client also asserted his right to testify. CASE DISPOSITION: The Jury Came back in less than an hour acquitting our client on all three charges. This was absolutely the right result.
