Cases

DAILEY V. LOS ANGELES UNIFIED SCH. DIST

Plaintiff: Attorney for the plaintiff/appellant, William W. Dailey. Dailey's son Michael was killed on a playground at Gardena High School. The family brought a wrongful death suit against the Los Angeles Unified School District. A verdict was found in favor of the defendants as the plaintiff had failed to establish negligence as the cause for their son's death. The Dailey's appealed this decision. Upon review of the case the appeals court concluded that there was sufficient evidence to support the claims made by the plaintiff. The court found that the trial court erred in their verdict. The judgement was reversed.

RESNIK v LA PAZ GUEST RANCH

1961 case in which said attorney represented the Appellant regarding an original issue over a promissory note in the amount of $30,463.85. Originally, partial summary judgement was entered for the Appellant, however this was set aside in another court hearing. The sole grounds for the order vacating judgment were appellant's failure to appear for the taking of a deposition after proper notice had been served upon him, and appellant's failure on two occasions to appear before the Court, pursuant to court orders which had been communicated to him. The case was remanded.
