I was served with a cease and desist order by Brian. He is representing Colorado National Speedway. Here are the events that occurred while I work there. Firstly, I never received a message from Brain on Tuesday at 11:00. I did contact Verizon to better understand the problem and they had no resolution. I have filed a claim with the EEOC and with the Colorado department of labor. A friend is planning to serve the owner and the GM with a summons next week. CNS broke Colorado Employment Laws around meal breaks and rest breaks. CNS didn't communicate with me when I was supposed to be working. I received contradicting information from my co worker and the GM. My co worker scolded me for being at work early and then she hung up on me. The GM had an issue with me not attending orientation which was Saturday. At that time I thought I had covid and believed it best to quarantine myself. On Monday I tested positive for RSV. I was at my most contagious prior to being tested. I offered the result to the GM, he said he didn't need them. I do have all this in writing, mostly text messages. The GM won't send my personnel file which I am legally entitled to. I was hired by the owner to run the main kitchen but that didn't happen. Instead I was a fry cook. The GM stated I would be getting 40 hours and I do have that via text message. I barely got 30 hours. One last thing I believe I was discriminated based on having a disability my sexual orientation and my age. The EEOC handles those matters but this will be addressed in court as well. Of course Brian never put anything in writing but he was aware of my physical disability which is a back issue. I continue to move forward in a professional manner but the same respect is not given. Oh, and I am being advised by a trial attorney who has never lost a case. I will also say that I'm doing this on principle not for the money. What's wrong is wrong. I can see Brian is putting false information online. Everything I said is 100% true. It is within my legal rights to speak the truth with respect and professionalism. No, I wasn't a customer as I am the plaintiff and he is representing the defendant. Deflammation of character? Let us talk abou that. Posting false information.
