Welcome to The Law Office of Nancy E. Wright Does Medicaid have you confused and frustrated? You are not alone. Chief Justice Roberts of the U.S. Supreme Court has written that “Medicaid law ‘is almost unintelligible to the uninitiated’” (quoting another Supreme Court Justice) and referenced a case where Medicaid was described as “an aggravated assault on the English language, resistant to attempts to understand it.” Yet Medicaid is the safety net for the most vulnerable of our community – children with serious health problems and people with disabilities that prevent them from working. Expecting them or their overwhelmed caregivers to navigate this complex system is not reasonable. Our practice is focused on helping these vulnerable clients with Medicaid long-term care services needed to stay in their home or community rather than enter institutional care, like a nursing home or an intermediate care facility for people with developmental disabilities. In Florida, these services are available through several “Medicaid Waiver” programs and, for children, through regular Medicaid. Florida operates two large Medicaid Home and Community-Based Services Waivers: iBudget Waiver (real name: Florida Medicaid Developmental Disabilities Individual Budgeting Waiver) targets children and adults with certain defined “developmental disabilities.” Long-Term Care Waiver (real name: Statewide Medicaid Managed Care Long Term Care Program Waiver) targets adults who are elderly or have disabilities that would meet a nursing home level of care.
