You would expect your lawyer to be transparent, compassionate, and willing to fight for you. Damisella was none. I hired her on behalf of my husband who was on ICE hold in bexar county. During consult I provided details of incident, 2 charges of arrest, marital situation and undocumented status. Was quoted retainer for both criminal/immigration. Paid immediately. weeks pass and I get call from paralegal stating ms.damisella was not made aware of 1 of the charges therefore requested additional retainer. Thought nothing of it; paid it also. My husband was bonded out of county and transferred. Next was bond with immigration which was to be submitted by our lawyer. ALL requested info needed for appplication 42B was provided. it had been submitted last minute of his master hearing and then rejected due to incomplete. Was told reason was due to criminal charges pending at the time however upon requesting copy of files AFTER we had terminated damisella it appeared that she failed to include CRUCIAL information on the application; therefor the judge automatically denied it. While he was in pearsall one of his charges disappeared thru public records. Brought to the law firms attention and it was disregarded. 1 month later he gets transferred back to jail for a missed court date which damisella was supposed to attend. She tells me the courts made a mistake; he shouldn’t have been transferred to county. later I find out (thru another lawyer) that when a charge disappears on public record is because there is a warrant for arrest. I would assume this would be common lawyer knowledge and I as a regular person who was CONTINUALLY monitoring his cases online for updates, would assume his lawyer who is being paid SHOULD do the same and would have caught the mistake beforehand. Had damisella taken action prior it could have avoided additional distress for the family and my husband who was being detained. damisella supposedly pulls strings and gets him in front of a judge that following week, he gets offered a plea deal, agrees, signs his part and the judge says it can be finalized same day if damisella would wait a few hrs. Damisella as always in a hurry to leave decides not to wait. I get another call requesting +$800 on top of $500 monthly already paid. Her reason “court fees” she tells my husband, and “because criminal processed a lot faster than expected” she tells me. with a temporary no contact order in place Damisella took advantage of lack of communication between me and my husband at the time but failed to realize my mother in law was checking in with him and myself every day. I sent a firm email to damisella addressing her unprofessionalism in providing misinformation, lack of best interest for her client being my husband and if it was about money she could have mentioned that rather than feed us lies. My mother in law also sent her a text regarding the same subject. The next morning i receive a call from her directly yelling and screaming stating she is a “dam good lawyer” and that “ I am being manipulated, I deserve better”. As if the situation isn’t difficult enough for me already. It brought me to tears to have to hear such a thing. Our lawyer should remain unbiased to begin with and should not get personally involved. My mother in law also got chewed out as well. Damisella was confronted by my husband and she denied ever saying those things or becoming irate over the phone with both myself and his mother. At this point we could no longer trust her as our lawyer or feel confident that she had his best interest. We went almost 2 months with no updates and no court hearing. My husband terminated damisella as representation and As soon as we hired a new lawyer he got him in front of a judge the next week and finalized his plea deal right after.
