Bob provided a quick free phone consult to answer some questions I had regarding my HOA I am in the process of interviewing lawyers for assistance with some understanding of governing documents.
As a first time homeowner, I had no experience with HOAs. My HOA failed to send me a notice when it was time to send in my dues, and instead of reaching out to me to let me know, the board chose to unleash Mr. Tankel's firm on me. The important thing to know is that Mr. Tankel does not charge HOAs any money for his services, and instead relies on extracting fines and fees from homeowners to make money. The first communication I received about my dues was via a notice being placed on my front door informing me that Mr. Tankel's firm had placed a lien on my home. When I called to find out what had happened, I learned that my small HOA fee, that I had never received a notice asking me to pay, had grown into thousands of dollars in fines. I consulted a (more reputable) attorney to find out how I can fight it, and he told me that while I would likely win a case against this vicious law firm, it would cost me more than the amount of money they were asking me for to hire an attorney to do it. I decided to settle, and get these scumbags out of my life.nnMy appeal to those who run Community Associations: While Tankel's services may seem appealing, because he does not charge you any money for his services, please know that you will be turning your members over to a truly vicious law firm that has no interest in improving your community. A law firm whose business model is to punish and extract as much cash out of your community as possible. You are not doing your community any favors when you hire this firm, you are only hurting people. You get what you pay for.
I consulted with Mr. Tankel regarding a possible homeowners' association where I live. He was extremely generous with his time (a free consultation) and the advice he gave me has proven to be spot on. I will definitely use this firm if we decide to proceed with this project.
I received a Notice of Intent To Record a Claim of Lien for an HOA payment that I thought was made via ACH. I contacted them repeatedly over the course of 2 days via phone and email. 48 hours later I finally got an email response saying that the preferred communication is email and that she would not speak with me over the phone. I expressed my frustration to her regarding a bill of $385 for a missed $75 payment. I asked if we could speak about this since I felt it was a little excessive. Still she refused to speak with me over the phone. I replied via email that I would just like to get this taken care of and paid immediately. It has now been 2 days since my last correspondence and I have yet to hear back. As a company charging what I feel is an excessive fee for a missed $75 payment I would expect to be able to speak with someone in order to resolve the matter. I feel that it's unprofessional to converse solely via email. I do understand that collections are not fun and customers can be irate, but that isn't an excuse for not calling or resolving matters promptly.
I am fortunate to have found Mr. Tankel and to have hired him in a dispute I had with an HOA. His understanding of the "safe harbor" law as well as collections and the limitations was truly helpful and saved me a great deal of money. I am forever grateful and highly recommend him for legal services!!! This guy is a superstar!
