Questions & Answers
Please describe a case in the last year or two where you made a big difference.
Assault. A Corporal in the U.S. Marine Corps was accused of assaulting his wife and two-year-old son with a loaded firearm while on board Marine Corps Air Station Beaufort. The Corporal faced nearly twenty years in confinement, dishonorable discharge, and the likelihood of separation from his son. The Corporal was fully acquitted of all charges and deployed with his unit soon after trial. (Healy 2012) Child Pornography. A Corporal of Marines was accused of receipt, possession, and distribution of child pornography at a general court-martial. The Corporal was facing nearly the rest of his life in confinement, as well as registration as a sex offender. The Corporal was found guilty of a lesser included offense of attempted receipt of child pornography but not guilty of all charged child pornography offenses. At sentencing, the jury members awarded only a six-month confinement and a punitive discharge; at the conclusion of the trial, a post-trial agreement was struck between the Corporal and his command to vacate the lesser included offense of attempted receipt of child pornography and suspend the punitive discharge. The Corporal was administratively discharged with an other-than-honorable-characterization of service and does not need to register as a sex offender. (Healy 2012) Sexual Crimes. U.S. Marine Lance Corporal was accused of sexually assaulting and forcibly sodomizing another Lance Corporal Marine while she was substantially incapacitated in her barracks room aboard Marine Corps Air Station Beaufort. The Marine Lance Corporal was facing life in confinement without the possibility of parole. Although the Marine was convicted, he received a sentence of time served and was released from confinement the same day his sentenced was announced. (Healy, 2012)
