Cases

KING v. FIRST CAPITAL FINANCIAL SERVICES CORP FCF

Attorney for the Plaintiff-Appellee in a case in which the Plaintiff obtained a mortgage loan through the Defendant and later accused said Defendant of predatory and illegal practices in charging a "document preparation fee". The original court refused to dismiss all allegations (one was dismissed), Defendant appeeals. Appeals court ruled that plaintiff did not allege that defendant's agents were negligent or misrepresented themselves as attorneys. Therefore, the complaint should be dismissed.

IN RE MARRIAGE OF ANTLE

Appellee: Attorney for the appellee, Tiffany Antle, now Tiffany Nyland. Tiffany and her husband, Cory Antle separated and were subsequently divorced in 2005. At the time they agreed to share physical and legal custody of their four year old son. Physical custody was spilt evenly between both parents, Cory obtained medical insurance for the child through his employer of which Tiffany was required to pay half. Cory was also ordered to pay $74.54 a month in child support. In 2007, Tiffany filed for sole physical custody of the child with visitation for Cory, as well as increased child support, coverage for her attorney fees and that he be solely responsible for the child's health insurance costs. Upon interviewing the child's family, including the parents, as well as the child's teachers, it was determined that the Tiffany had no grounds for requesting physical custody and that petition was denied. She was granted an increase in child support as her income had not change but Cory's had increased considerably. She was also awarded payment of attorney fees, but her petition to cease contributions to the child's health insurance were denied.
