Ravenswood Disposal Services v. Lagunas et al., 2019 IL App (1st) 181449WC
We represented the decedent's estate in a Worker's Compensation death case, where the minor son of the employee was subsequently adopted by his stepfather after the employee's death. The employer denied an employer-employee relationship at the time of accident, denied that the minor was a dependent of the employee at the time of accident and argued that any rights that the minor may have had to benefits under the Worker's Compensation Act extinguished as a result of the subsequent adoption. The Appellate Court affirmed the rulings of the Commission and the Circuit Court, in favor of decedent's estate on all issues, including upholding penalties and fees for the employer's failure to pay the decedent's medical expenses.
