Defendant: Attorney for the defendant/respondent, TransAmerica Insurance Company. The plaintiff, George Borg, appealed an adverse judgment in his claim against TransAmerica. He had originally filed a claim for breach of duty to defend under the terms of comprehensive general liability policy. The appellant argued that the trial court erred in their determination that the defendant had no duty to defend the lawsuit because the encroachment was created prior to the effective date of the insurance policy. After review of the original case and decision as well as the insurance policy purchased by the appellant, the appeals court agreed with the appellant. They found that the court had erred in their decision and it was ordered that the judgement be reversed.
Attorney for the Defendant (Respondent), Safeskin Corporation, in an Appeals case in which the trial court granted summary judgment in favor of four manufacturer/distributor defendants who produced and supplied latex gloves that the Plaintiff used in the course of her employment as a nurse, and that caused her to experience allergic reactions. The trial court ruled that the Plaintiff's claim was not filed in time. On Appeal, the summary judgement was overturned.
