Minnesota Criminal Defamation Statute Declared Unconstitutional
John Arechigo successfully challenged the constitutionality of Minnesota's from criminal defamation statute in State v. Turner. The old statute was overbroad and violated the right to free speech. The Court of Appeals agreed and declared the statute unconstitutional.

Please describe a case in the last year or two where you made a big difference.
Two counts of 3rd degree criminal sexual content were dismissed. My client was in his early 20s - he had a consensual sexual encounter with a younger girl who later claimed she was passed out when my client had sex with her after a full investigation of the night in question, we discovered the girl was on her phone the entire night and early morning hours when she claimed to have been passed out the state no longer believed the credibility of the girl after this information - along with other investigative information - was presented to the prosecutor; the prosecutor dismissed all charges my client as facing 48 months in prison and years of registering as a sex offender.

Hard work, word of mouth - built strong referral base, responsive and attentive to client phone calls and questions, professional work ethic.
What should clients look for in a lawyer?
Experience with the client's particular type of case. If talking to an attorney about your case, ask if that attorney will be the one handling the work on your file or if it will be passed off to a younger associate or paralegal.
How important is local knowledge to the success of your cases?
Not as important as is commonly thought. The types of crimes, the statutes controlling the offenses, defenses available, the rules of criminal procedure, and the rules of evidence are the same throughout the state of Minnesota; these don't change depending on where the offense occurred.
What information can you provide in a free phone consultation?
General information concerning the elements the state needs to prove to convict a potential client of the crime he/she is charged with potential sentencing issues a potential client is facing if convicted of the crime he/she is charged with what to expect at a particular type of court appearance an approximate fee for representation in a potential client's case.

Type of crime charged with, date of offense, place of offense a court file number is extremely helpful if the person happens to have it.
What differentiates you from other lawyers in your community?
Owning my own law firm, and being one of the two attorneys here, allows me to be very responsive to my clients we do not pass off a client's file to a paralegal or law clerk; I handle 100% of the work on my client's file most attorneys at larger firms will pass a file off to a young associate or ask a paralegal to do the research on a file.
What is the most rewarding aspect of your job?
Obtaining a good outcome for a client having charges dismissed against a client I know to be innocent.

Spending time with my family and daughter, going to the lake, sports
