Attorney John C. Leggett has been practicing law for 24 years, since receiving his Juris Doctorate from Mississippi College School of Law in 1990. After being in private practice for many years, John was unanimously appointed by the Superior Court Judges of the Cherokee Judicial District to fill the unexpired term of the late Chief Magistrate Judge. At the end of that term in the fall of 2012, John joined with Attorney Barry Benton in anticipation of Mr. Benton’s imminent retirement and John’s return to private practice. John C. Leggett, PC is again a private practice law firm specializing in estate planning, elder law, probate and real estate. His firm prepared over 1000 estate plans in 2013 and again in 2014. The firm assists with the coordination of multi-state planned-giving services for several charitable organizations, prepares instruments to facilitate the charitable giving intentions of donors, assists field representatives and planned-giving directors, presents seminars on estate planning and elder law concerns for client groups, and conducts will clinics and planned giving seminars for various non-profit organizations throughout the southeast. In addition, the firm’s probate practice includes representation of estates, establishment of guardianships, and various related matters. John is the son and grandson of United Methodist ministers, and his grandfather was the head of the Mississippi Methodist Foundation, the planned-giving department for the state's two Methodist conferences, from 1968 through 1989. John graduated from Millsaps College in 1985 where he received his B.A in History. He is married and has three daughters.

Deckard v STATE

Attorney for the Appellant in a case in which said Appellant was initially convicted of DUI based on failure of sobriety test. Said Appellant failed to successfully argue that he was misinformed as to the consequences of his failure to submit to a chemical analysis because the Georgia Department of Public Safety is without authority to absolutely suspend or revoke a nonresident's driver's license (the arresting officer told him that Georgia had the authority.) On appeal, the test results were rendered inadmissible since they were gained by misleading information.

JEFFERSON v. THE STATE OF GEORGIA

Appellant: Attorney for the appellant, Eric K Jefferson. On September 30, 1993 Jefferson was sentenced to five years in prison after pleading guilty to aggravated assault. It was a plea deal that took place during his jury trial for rape charges. After his sentencing Jefferson sought to withdraw his guilty plea, the motion was denied and Jefferson subsequently filed an appeal. During the appeal the judge found no wrong doing during the original trial and that the appellant was in the right frame of mind and not coerced when he entered his guilty plea. The motion was denied and the decision of the original court was upheld.
