About Kraig

Kraig Marton brings a wealth of experience to his personal goal of fairly and quickly solving problems for his clients. He solves his clients' problems utilizing every tool available from mediation, settlement (if possible), to aggressive litigation, when necessary.

In his early years as a lawyer, Kraig worked in a general practice where he did everything from divorces to foreclosures, real estate to business law, as well as general litigation. However, with experience and successes, he has narrowed his practice to the areas of Healthcare law, Employment law, First Amendment law and Complex Litigation. Kraig has been listed in Woodward & White's publication, "Best Lawyers in America," in three different areas, Healthcare, Employment, and First Amendment law. Only approximately 850 Arizona lawyers have been listed in this publication and few are listed in more than one area.

In his Healthcare practice, Kraig primarily represents what he calls "professionals in trouble." He has represented most types of healthcare professionals in front of their licensing boards, primarily M.D.s, but also D.O.s, D.C.s, nurses, physical therapists, homeopaths, naturopaths, and others. He also assists healthcare professionals with other issues from medical malpractice to peer review, to insurance coverage to managed care issues. He is the immediate past president of the Arizona Association of Healthcare Lawyers (AAHCL) and has been on its Board of Directors for more than seven years.

He has been involved in numerous administrative proceedings, from OAH to appearances before most every health care board in the state.  He is the immediate past chair of the State Bar Administrative law section.

In his Employment practice, Kraig primarily represents employees, but he also represents small and mid-size employers. He has litigated numerous employment cases, from discrimination to wrongful discharge, sexual harassment, whistle blowing, and straight wage and hour claims. He is responsible for many noteworthy reported employment decisions and he sees himself as a protector of the "little guy."

In his First Amendment work, Kraig has brought suit against most of the major media in the state of Arizona, and is responsible for many of the noteworthy defamation decisions issued from Arizona Courts in the last fifteen years. He has also pursued the national media on occasion. He was counsel in the case of Boswell v. the Phoenix Gazette, where the Arizona Supreme Court found Arizona's media retraction statute to be unconstitutional, as well as the cases of Dombey v. the Arizona Republic and Currier v. Western Newspapers, which are cases where the Arizona Courts have defined and applied the "actual malice" standard. He also counsels clients on pre-publication review (to avoid defamation), insurance coverage, and internet and technology issues.

In his Complex Litigation practice, Kraig does not hesitate to pursue any complex litigation matter, usually on behalf of plaintiffs. Kraig regularly handles appeals and has been counsel on dozens of reported decisions. He has substantial experience in everything from racketeering claims to insurance coverage, contracts to personal injury cases.
