Please describe a case in the last year or two where you made a big difference.

I handled a case in the 5th Circuit, Court of Appeals involving a young man who, after suffering a hemorrhagic stroke, was denied rehabilitative care by his self-funded health plan. My work ensured he will receive desperately needed medical care which would have been otherwise denied to him.

How did you build a successful practice?

The single, most important trait to have is tenacity. The clients who hire me have had something taken from them. Sometimes it's their income, when their disability benefits have been denied, other times it's their medical care, and in some instances, it's the life insurance benefits they thought they had to protect their family. The "takers" are usually powerful corporations that are not accustomed to having their decisions to deny challenged. When this happens, you must be willing to appeal. When the appeal is denied, you must be willing to take the case to court. If the court rules against you, you must be willing to take the case to an appellate court. In an ERISA practice, there's rarely such a thing as a quick and easy resolution. A successful ERISA attorney must be tenacious and unwilling to give up.

What should clients look for in a lawyer?

ERISA cases are litigated in federal court. A client should find an attorney who regularly tries cases in federal court. They should ask to see copies of decisions the attorney has won in the district and appellate courts. If you find an attorney who has won decisions in federal, appellate courts, hire him or her.

How important is local knowledge to the success of your cases?

Important. I believe you're much more likely to be successful if the judge that will be deciding the case is familiar with the attorney bringing it.

I try to answer any questions the client has. I can often describe how the entire process will likely play out.

What information do you need in a free phone consultation?

Date of denial, name of the insurance company, Social Security status, medical condition forming the basis of the claim, whether the treating physician supports the claim.
