About Marc
In employment cases, Marc has prevailed in arbitrations, bench trials, jury trials and appeals. Recently, in June 2015, Marc won an appeal of a class action case involving more than 300 California local-hourly truck drivers. Marc filed this case in the Superior Court of Alameda County in 2007. Over the last eight years, Marc has persevered for this class of employees who allege they were systematically denied meal periods and rest periods by their employer. Since the employer’s request to the California Supreme Court was denied, Marc expects to proceed to trial in this case in December 2015. Marc’s other experiences handling complex class action (wage & hour) cases have resulted in the certification multiple classes of employees and millions of dollars in recovery on behalf of those classes.
Throughout his legal career, Marc has successfully represented hundreds of individual employees in a wide range of employment matters including, wrongful termination, harassment, discrimination, retaliation, breach of contract, unpaid wages/commissions and other employment issues. Recently, in April 2015, Marc recovered $329,500.00 on behalf of an individual employee who alleged that he was improperly denied commission wages by his employer.
In 1999, Marc left his employment with a mid-size California law firm and helped co-found Advantage Law Group in San Diego, California. Since that time, Advantage Law Group has grown to add two more partners and two additional offices in California. Advantage Law Group’s other offices in California are located in Irvine and San Francisco. Marc has served as Advantage Law Group’s Chief Financial Officer since 1999.
Since passing the California Bar Examination in 1993, Marc has gained admittance to all of California’s state courts and the Federal Southern and Central District Courts in California. From 1996 to present, Marc’s employment practice has included all major venues in California, including San Diego, Orange County, Los Angeles and San Francisco.
Marc attended Willamette University College of Law (“WUCL”) in Salem, Oregon from 1990-1993. While attending WUCL, Marc served as Senior Law Clerk to Daniel Ellis, Chief Judge of the Oregon Employment Relations Board (“ERB”). In law school at WUCL Marc also worked as a law clerk for the Marion County District Attorney’s Office (“DA”).
In his career Marc has generously pro bono legal services to indigents and supported the Special Olympics and American Cancer Society. Originally from Teaneck, New Jersey, Marc attended the University of Maryland College Park (“UMCP”) and received a Bachelor’s Degree in Political Science from UMCP in 1987. Marc has lived in San Diego since 1993. Marc is married and has three children.

Please describe a case in the last year or two where you made a big difference.
In February 2017, after more than 9 years of litigation and two appeals, we received final approval for a class action settlement. Initially, the case was filed against a trucking company on behalf of a class of Local Hourly Drivers who were denied adequate meal/rest breaks. We viewed the lack of adequate meal/rest periods as a public safety issue. Our work on the case has resulted in improved conditions not only for truck drivers in the state of California, but as well, as all Californian's who travel the same roads as these truck drivers.
How did you build a successful practice?
Since our firm's inception in June 1999, we have placed a premium on responsiveness to our clients and their concerns. We return all client calls/inquiries within 24 hours, my clients have access to me through my office phone, personal cell phone and email.
What should clients look for in a lawyer?
I believe it is important for a client to meet directly with an attorney. That is why we offer free initial consultations in our office. A client should judge the attorney's level of professionalism in that one on one meeting and also conduct independent research on line to determine what other former clients are saying about the attorney.
How important is local knowledge to the success of your cases?
Many of the files we handle are referrals from other attorneys. A large number of those referrals come directly from defense counsel whom have opposed us on various cases and appreciate our professionalism and excellent work.
What information can you provide in a free phone consultation?
The purpose of the consultation is to review any relevant client documents as well as any information told to us directly by the client. We then provide the client with information on their possible claims as well as an estimate of what we believe we can do to help.
What information do you need in a free phone consultation?
In order to provide a proper iniitial consultation, we like to have the client provide us with relevant documents, including any offer letter, performance review(s), disciplinary action(s), recent itemized wage statement, written grievances by the client, responses to any grievances by the employer, letter or form providing a reason for the termination, or other written agreements or arbitration agreement. If the client does not have these documents in their possession, it is not a concern. We can make a request for personnel/pay records directly from the employer.
What differentiates you from other lawyers in your community?
Our firm is differentiated from other firms providing the same or similar services in that we utilize a team approach to our cases. All four partners in our office provide input on the cases we handle. We do not work with associates or paralegals. Every case is professionally handled by our team of attorneys with a minimum of 20 years experience in employment law.
What is the most rewarding aspect of your job?
Our reward is ensuring that our clients are adequately compensated for their losses, and that our clients all make responsible decisions about their case with our guidance. In every case, we provide our client a voice and an opportunity for our client to stand up for him/herself in response to adverse circumstances.
What are your other interests in addition to law?
Outside the practice of law, my partners and I all have families and we are committed to the success of our wives, partners and children.
Are you involved in your community?
The attorneys in our firm are all family people involved in the community. We have generously donated our time coaching little league, recreational soccer or other sports for our respective children. We support legal organizations such as the California Employment Lawyers Association as well as the local county bar associations where we practice. We have generously donated to charity events supported by our colleagues, vendors and even opposing counsel upon their request.
