Questions & Answers

Please describe a case in the last year or two where you made a big difference.

Clifton Onunwor v. Warden Ernie Moore, No. 15-3686 (6th Cir. 2016) is a case where my writing skills factored into the outcome. Clifton Onunwor was convicted of the aggravated murder of his mother and related charges in connection with her 2008 shooting death. Mr. Onunwor filed a Petition for a Writ of Habeas Corpus in 2014. I wrote the Return of Writ for Mr. Onunwor's Petition For a Writ of Habeas Corpus, and I won that case in the U.S. District Court for the Northern District of Ohio. Mr. Onunwor appealed to the Sixth Circuit Court of Appeals. I was transferred to another section of the Ohio Attorney General's office after writing the Sixth Circuit brief, but before the case was complete. One of my colleagues reviewed my brief and successfully argued the brief in his first argument before the Sixth Circuit Court of Appeals.

How did you build a successful practice?

Reputation is the most important key to building a strong and successful practice. Many lawyers charge large fees fail to counsel clients during some of the most difficult parts of their lives. The Law Offices of Marc S. Davis, PLLC seeks to do exactly the opposite. We charge reasonable rates for reasonable fees. Our clients are very important to us, and we make sure that they know it.

What should clients look for in a lawyer?

Clients should look for litigators with strong writing skills. Although courtroom dramas hinge on improbable scenarios at the conclusion of a trial, the practice of law involves mostly written arguments before the court. Paper is our product, and judges rely on lawyers to present succinct legal arguments when they draft legal opinions.

How important is local knowledge to the success of your cases?

Local knowledge is less important to the success of my cases because I have been involved in more federal litigation than lawyers of similar experience. The majority of lawyers will spend an entire career in litigation without arguing before a U.S. Court of Appeals, but I have already had that distinct honor on three occasions.

What information can you provide in a free phone consultation?

During phone consultations, my first question is always, "how can I help?" Although I provide general information on relevant portions of law, I spend most of the consultation acquiring key facts so that I can use them to form the best arguments in furtherance of my client's goals.

What information do you need in a free phone consultation?

In a free consultation, I need to obtain the key facts from a client and determine his/her goals for the engagement. The most important facts are often dates because they control the applicable statutes of limitations for my client's claims.
