Marc's Philosophy and general statement of the law:
A lot of times I am asked what I think about cases. I always start from the premise that the person is not guilty or not responsible for the actions alleged. I always receive the discovery from the State before I make a decision. No two cases are ever alike. Each case presents a separate set of facts.
Beware of legal advice without a review:
I find it interesting that lawyers get on the phone and give immediate answers to issues when they have not seen the drug test results, the discovery, photographs of victims, statements from witnesses and the like. This information can only be obtained by applying to the courts and to the state's attorney's office for their discovery. In Juvenile cases, the only way to obtain police reports is to have an attorney enter their appearance. The discovery is automatically provided to us by the state.
It's my job to find police mistakes:
Once I am hired in a case, I normally have the information within two weeks. In DWI cases, the State Police are now using in-car camera videotapes. Often these tapes can be quite helpful to the defense. I obtain these tapes at the barracks at a cost of $75.00 and I encourage everyone to get theirs.
I would prefer to do it myself, because once you are in the barracks, you are subject to being questioned by the police. I tell everyone not to speak to the police any further. A lot of time the police will miss something and they will call you directly to fill in the blanks of something that may or may not have been done correctly or to obtain an admission. Police are human, too, and they make mistakes, and it is our job actually to capitalize on those mistakes.
Serving you in the most efficient and reasonable manner possible:
I try to keep my fees reasonable, and I try to give all my clients my cell phone number so they can ask me questions as they come up so they do not lose sleep worrying and thinking about them.
My office is equipped with a conference room, high-speed copier, high-speed fax machine, camera equipment, audio recording device and the like.
Anytime somebody leaves you a message - particularly an alleged victim - that needs to be saved. Once I have a couple of weeks to review the case, I can give you an honest review of what I think will occur. I hope to serve you in the most efficient and reasonable manner that I can and keep your cost down. But this requires your 100 percent honesty with me, as a privilege exists between lawyer and client, and I need to know the truth of what has occurred.

Avoid mass-mailing" lawyers:
If you've been charged with a crime, you will begin to receive literally hundreds of letters from out of town lawyers. I advise against using these lawyers because they are buying list of arrested people and they are called mass mailers. The letters are meant to scare you. They lack the personal relationships with the State's Attorney and the Court to adequately represent you. It is always best to get a local lawyer.
