FRENCH V. W.C.A.B. (FOSTER WHEELER)
Respondent: Attorney for the respondent, Workers' Compensation Appeal Board. A claim was filed against the respondent by William French, Jr. He petitions for a review of an order of the board which denied his reinstatement petition. French was injured while working for Foster Wheeler Corporation and began receiving total disability benefits. After four years he filed to have his benefits modified and began receiving partial disability. Five years later he petitioned to have his full benefits reinstated and his petition was denied. A judge found in favor of the defendant and denied his petition. He subsequently appealed and upon review of the case it was determined that the court did no err in their decision. The judgment was affirmed.
Questions & Answers
Please describe a case in the last year or two where you made a big difference.
I have recently settled a workers' compensation claim pursued by a middle age daughter who had taken on the task of caring for her extremely ill mother and unfortunately injured her back. Payment was made for all medical bills and she received a lump sum payment. I won a claim for a local police officer who suffered a heart attack on duty that was contested by the insurance carrier as work related. Medical bills and weekly cash benefits were paid.
How did you build a successful practice?
I have been a Workers' compensation litigator for 29 years. Have developed my knowledge and skill in the field working for the insurance carriers and employers. Now using my knowledge of their tactics to best represent my clients in their pursuit of hard earned benefits. I have appeared in court before workers' compensation Judges thousands of times as well as representing clients at settlement mediations.
What should clients look for in a lawyer?
Injured individuals seeking a workers' compensation attorney should interview their lawyer prior to signing a fee agreement. The lawyer chosen should have extensive experience in the field. Should have a record of appearing in court and mediations. You should expect your lawyer to be available to answer your questions at hours after the office has closed for the day.
How important is local knowledge to the success of your cases?
My practice has been based in the Luzerne and Lackawanna counties for 29 years. I am familiar with all the practices of the local judges and with counsel who practice here as defense lawyers whether they have local offices or travel from Philadelphia and Pittsburgh.
What information can you provide in a free phone consultation?
All initial consultations regarding Workers' Compensation and Personal Injury claims are free of charge whether in office or by phone. There is no time limit to these consultations. With Personal Injury and Workers' Compensation matters a fee is only paid if we win or reach a settlement acceptable to the client.
What information do you need in a free phone consultation?
When seeking a consultation with any lawyer involving an injury you should be prepared to provide complete facts about the injury suffered and circumstances of the accident. The names of all parties involved and a complete medical history.
What differentiates you from other lawyers in your community?
The fact that I have practiced for 29 years in this area limiting my practice to injury cases makes me the correct choice to represent you and your family
What is the most rewarding aspect of your job?
I receive the greatest satisfaction in practicing law when I am able to recovery for my clients the benefits they have earned or helped them recover at least a portion of what they have lost in an accident.
What are your other interests in addition to law?
I have a large family with a wife and five children who outside my practice have filled my life with adventure watching them grow. My parents were hard working parents. My Mother worked in the dress factories of North East Pennsylvania. My Father was a machinist for 30 years in a local factory. My brother, sister and I were the first Brady's to earn college degrees and we have all kept alive, through our own families, the respect for others and work ethic learned from our parents.
