About Michael

As a Partner on the Business Team, Mr. Carey has principal responsibility in all aspects of Chapter 11, 13 and Chapter 7 bankruptcy practice and is primarily responsible for representing both debtors and creditors.

An experienced bankruptcy and commercial litigator, Mr.Carey brings and defends non-dischargeability actions, preference actions, and other adversary proceedings in Bankruptcy Courts, and has handled a variety of commercial matters on behalf of debtors and creditors in federal and state courts of New York and New Jersey.

The following is an example of the wide range of bankruptcy and commercial matters handled by the firm:

  • Special Counsel to Sullivan County Attorney in the Concord Resort bankruptcy proceeding. Sullivan County's claim was in excess of $8,000,000
  • Representation of a Chapter 7 Trustee in the liquidation of a mortgage company in Sullivan County
  • Representation of Chapter 7 Trustees in numerous consumer bankruptcy proceedings
  • Representation of commercial landlords in Chapter 11 and Chapter 7 bankruptcy proceedings
  • Representation of trade creditors in bankruptcy and state court proceedings
  • Representation of a public water company and public sewerage company in a sale to a municipality
  • Special counsel as to bankruptcy matters for an Orange County city in real property tax enforcement proceedings
  • Representation of real property owners in Section 505 proceedings to challenge real property tax assessments

Mr. Carey is a member of the New York State Bar Association, American Bar Association, New York County Lawyers Association, Orange County Bar Association, and President of the Mid-Hudson Bankruptcy Bar Association.

By virtue of designation as special counsel to the Mid-Hudson Legal Services on bankruptcy matters, Mr. Carey received the 1997 Pro Bono Award from the Orange County Bar Association. In May, 1998 he was a guest speaker at the New York State County Lawyers Association meeting to discuss "Bankruptcy and the Municipality."

Mr. Carey is a 1984 graduate of Seton Hall University and received his Juris Doctor degree in 1987 from Seton Hall University. He was admitted to the New York State Bar in 1991 and the New Jersey State Bar in 1987, and is admitted to practice in the United States District Courts for the Southern, Eastern, Northern and Western Districts of New York and the District of New Jersey.
