Questions & Answers

Please describe a case in the last year or two where you made a big difference.

The Fernandez Law Office handles a wide variety of cases and results do vary from Client to Client, because the facts, witnesses, circumstances, investigation, prosecutors to name a few tend to change and each can play a significant factor in how or when a particular case gets resolved. Recently we were hired in a Felony Child Abuse and Misdemeanor Battery case stemming from a breakdown in the marital relations resulting in an ugly verbal and physical altercation while the mother was holding the parties child, we were hired very early on by the Defendant's family and able to quickly assess the circumstances leading up to the incident and possible weaknesses in the State's case, identify the most essential issues as well as proactively address the major concerns surrounding any continued need for anger management therapy and proper medication management. We had our Client evaluated, turns out he did not need that type intervention but rather some other less serious counseling which he voluntarily agreed to complete. As a result of our timely, good faith actions in this regard, we were able to get both charges dropped. In another recent case, we were hired by a Client, who had been involved in a motor vehicle accident after she left work early due to issues with some new medications and became disoriented driving back home. During the crash investigation, our Client was interviewed and eventually arrested for DUI due to her appearance to the responding Deputy, where she supposedly displayed some typical signs of impairment. She was also taken to a nearby hospital after she appeared to experience some distress and blood pressure issues. She was admitted, legal blood was taken from her and she was released by the hospital on the same day but not taken to the Jail. Two months later she was rearrested and given a court date. We were immediately hired, filed a Motion to Suppress and Notice of Expiration of Speedy Trial (taking procedural advantage of the State's failure to timely prosecute the case). The case was set for Trial but dropped by the State because they didn't have enough time to get all of their evidence/witness ready for Trial. These two cases demonstrate that hiring an experienced attorney who knows how to best handle your case, substantively and procedurally, an can sometimes make a substantial difference in how it ultimately gets resolved.

How did you build a successful practice?

Doing lots of Trial work is how I helped build my practice. The more I was able to hone my courtroom skills and accumulate favorable jury outcomes, the more word started to spread about my abilities. I also learned that developing and maintaining good Client relations was an essential factor in getting more referrals and recommendations. To this day, we pride ourselves in personally addressing our Client's legal needs and problems.

What should clients look for in a lawyer?

Proven Trial experience over a course of years as well as an established reputation for being an effective courtroom advocate is critical. The greater an attorney's overall experience, the more he can draw from in order to represent your interests.

How important is local knowledge to the success of your cases?

Local knowledge can be very important because the best advocate know his audience (the Judge) and is able to use every insight to his Client's advantage.

What information can you provide in a free phone consultation?

General, but useful, information about our ability to handle a particular case and what to anticipate as the case gets processed.

What information do you need in a free phone consultation?

We need to have as much information as possible so we can better assess the case and provide competent, timely advice.

What differentiates you from other lawyers in your community?

My more than 24 years of courtroom experience, my insight as a former prosecutor, as well as my proven ability to quickly identify key aspects of your case and your defense is what sets me apart from other younger, less seasoned defense attorneys. Likewise, I believe my bilingual skills, also allow me to better, more directly communicate with Hispanic clients and their families. When it comes to defending your liberties, you simply cant afford any room for misunderstanding and/or trouble in translation.

What is the most rewarding aspect of your job?

Helping Clients resolve their legal problems and advising them on how to best avoid repeating them in the future.

What are your other interests in addition to law?

I am a Sports fan and really enjoy athletic competition, both collegiate and professional.
