Among other matters, Jeff successfully led the defense in federal court of a boat-builder wrongfully implicated in the “Ethan Allen” tragedy on Lake George in which twenty persons perished, winning summary judgment on the client’s behalf; prosecuted a $4.5 million jury verdict in Columbia County against Rensselaer Polytechnic Institute (RPI); argued before the New Jersey Supreme Court the landmark consumer fraud class action, Lee v. Basic Research, which resulted in a unanimous, 9-0 opinion overturning the lower courts’ decisions denying class certification; and argued before the Massachusetts’ Supreme Judicial Court the precedent setting case of Tyler v. Michaels which declared unlawful the collection of personal identifying information in connection with retail credit card transactions. Jeff’s reputation for excellent results and dogged preparation, make him a formidable adversary, regardless of which side of the aisle any particular dispute may place him. Jeff is no stranger to the Courtroom, and has successfully tried to verdict a diverse number of matters, including securing a defense verdict for Madison Square Garden and Amtrak in a federal jury trial in the Eastern District of New York; winning a multi-million dollar jury award in a state court breach of contract action in White Plains; prevailing in a nine month real estate fraud arbitration in New York City in which he recovered a multi-million dollar judgment; and securing on the eve of jury selection tens of millions of dollars for clients with catastrophic losses. Jeff’s experience in the sports, media and entertainment industries has also allowed for his successful handling of a variety of matters including claims of copyright infringement, trademark infringement, breach of television Executive Production Agreements, royalty disputes, and artist-management conflicts. Jeff has advised television broadcast journalists, senior media executives and executive producers on a wide range of issues concerning non-competes, first amendment rights, and compensation and severance disputes. Jeff led the successful prosecution of the wrongful death action of Baltimore Orioles’ pitcher Steve Bechler, helped extricate former light heavyweight World Champion boxer Reggie Johnson from an onerous promoter’s contract, and counseled the Estate of Tito Puente, the Latin Salsa King, in a misappropriation of name and likeness litigation. Jeff also spearheaded the successful prosecution of the United States Tennis Association’s (USTA) multimillion dollar breach of contract action against a sponsor of the US Open, as well as defended the USTA against a claim of disability discrimination which he successfully had dismissed, and successfully represented Heineken in a breach of contract action arising from a marketing services agreement. Jeff regularly counsels media and entertainment clients in contract negotiations, severance disputes, and intellectual property matters. Jeff’s skill with complex litigation has also helped the Firm to develop significant experience handling a diverse array of maritime and admiralty matters. Jeff has successfully defended boat builders, marinas, charter vessels, stevedores and other marine interests in both federal and state litigations throughout the Country. Among other successful outcomes, Jeff defended a marine terminal operator in a federal wrongful death action in Portland, Maine; represented a luxury yacht manufacturer in a premises liability action in federal court in New Jersey; defended a Manhattan sight-seeing tour operator against a personal injury claim; and handled a Society of Maritime Arbitrators (SMA) arbitration concerning the scope of a contractual indemnity between a terminal operator and a multinational transport company. The Firm’s experience includes handling claims arising under the Jones Act, the Longshore and Harbor Workers Compensation Act, and the Outer Continental Shelf Lands Act, as well as prosecuting exoneration from and limitation of liability actions. Frank concentrates his practice on civil litigation, with an emphasis on medical malpractice injury, general injury cases, civil rights and class actions. He obtained a bachelor’s degree in political science in 1992 from the State University of New York at Albany where he also played rugby. Frank then attended St. John’s University School of Law in Queens, New York, during the evening while working as an investigator for the State of New York, followed by the New York City Corporation Counsel, and then AIG Insurance Company as a litigation claims adjuster. Frank obtained his law degree in 1998, was admitted to the New York State bar in 1999, and eventually all four federal district court bars for New York, as well as the Second Circuit Court of Appeals. He began his legal career in the New York City office of one of his law school professors representing injury victims and then moved on to a large firm representing corporations in product liability litigation. Frank then relocated to Massachusetts where he had to take two additional bar exams to be admitted to the Massachusetts bar in 2002 and the Rhode Island bar in 2003. Frank continued with injury law there, particularly construction and maritime cases under the Jones Act involving accidents at sea, including several death cases. Frank relocated to Central New York in 2006 and worked for the litigation firm of O’Hara, O’Connell & Ciotoli representing victims of medical malpractice, workplace injuries, general injuries and wrongful labor and employment practices. Frank has been appointed class counsel in several class action cases and achieved over $17,000,000 in class action settlements since 2015 for FLSA and New York Labor Law violations. In all, since 2008 Frank has recovered over $27,000,000 in damages for his injury and employment clients. Frank lives in Fayetteville, N.Y. with his wife and children. Mr. Aspromonte is the managing partner of Dansker & Aspromonte. He is a native New Yorker and the son of second generation Italian immigrants. By the age of 16, he had lost both parents and entered the work force. While attending high school and college, he supported himself by working at a large retail pharmacy where he quickly rose to a managerial position. He graduated from Bernard M. Baruch College in 1974 with a Bachelor in Business Administration and in 1979, obtained his Juris Doctor at Brooklyn Law School, where he formed the Italian-American Law Students Association. He also secured a clerkship as legal assistant to the warden at the Brooklyn House of Detention for Men. After he was admitted to the bar, Mr. Aspromonte opened his first law office and concentrated in civil and criminal litigation. He subsequently limited his practice to personal injury and medical malpractice. In 1989, he merged his practice with Paul Dansker and formed Dansker & Aspromonte. Throughout his career, Mr. Aspromonte has tried many cases and negotiated millions of dollars in settlements. He gained notoriety in several cases, most notably in the case of Wan v. Rochester University Medical Center involving a young college student who died during a routine clinical research trial. Mr. Aspromonte credits his successes to the work ethic he learned at a very young age. He prides himself on being completely self-made. “Luck has nothing to do with it,” he proudly says. “Everything I’ve achieved was accomplished through hard work and determination.” And that work ethic is reflected in every aspect of the practice. He takes nothing for granted, and the standard of hard work and determination he set still provides the cornerstone for the effort that goes into every case accepted by the firm. Today, Mr. Aspromonte serves as president of the Congress of Italian Americans Organization (CIAO), which provides social services to individuals who are disadvantaged. He is a founder and board member of Community Understanding for Racial and Ethnic Equality (CURE), which brings diverse ethnic, religious and civic leaders together to promote harmony and to resolve disputes. He is a founding member of the New Era Democrats (NED), a political action group that supports qualified candidates regardless of party affiliation, and he serves on the board of the Ralph J. Sansone Foundation, a philanthropic organization that raises money and awards scholarships to deserving students in financial need.

In 1989 Mr. Dervishi obtained his law degree from Tirana University School of Law. Mr. Dervishi worked as a special agent of the General Investigations Office with his office in Tirana. In 1994 he was elected as the Deputy Attorney General by the Albanian Parliament. He served as the Deputy Attorney General of Albania from 1994 to 1998. In 1998 he immigrated to United States. His family arrived in the U.S. within a few months. Upon his arrival in Washington D.C., he met with members of the U.S. Senate and House of Representatives since his trip was sponsored by the U.S. government. Beginning in 2003, he began to attend Pace University School of Law and graduated with a Master of Law degree in May, 2004. He is now admitted to the New York State Bar and practices law in all courts in our state.
