Who was “at fault” was a contested issue that resulted in the parties going to trial. Near the conclusion of the Plaintiff’s case, Mr. Chiniche and co-counsel secured a settlement for their client in the amount of $350,000.00 when the Court recessed the trial for lunch. This case was settled without waiting for a verdict from the jury. 18 Wheeler Accident – Mr. Chiniche and co-counsel represented a 23 year old Louisiana student who was driving home with his mother after visiting relatives for the Thanksgiving holidays when they had an accident with an 18 wheeler in Rankin County, Mississippi, along Interstate 20. The driver and his mother incurred medical expenses in the months following the accident and after almost a week long trial in the U.S. District Court in Natchez, the jury, before comparing the fault of both parties, awarded the student and his mother $80,000.00 for past, present, and future medical expenses. 18 Wheeler Accident – Mr. Chiniche represented a female student at the University of Mississippi who was a guest-passenger in a vehicle hit by an tractor-truck trailer carrying supplies to a retailer in Oxford, Mississippi. Mr. Chiniche filed a federal workers compensation case under 5 U.S.C.A. § 8101, et.al. under a complicated theory of legal liability termed a “mental-mental” disability. Mr. Chiniche’s client was awarded past, present, and future medical care as it related to his work disability along with lost wages during the employee’s rehabilitation. Criminal Law Criminal Law – Mr. Chiniche represented a young man from Tennessee indicted on a murder charge by a Marshall County grand jury. After a careful review of the evidence in the case and after successfully arguing that his client had no role in such an unfortunate incident and that a fellow co-defendant’s story did not match the evidence in the case, the District Attorney’s Office dismissed the charges against Mr. Chiniche’s client before trial.
