Peruta v. County of San Diego, Case No. 10-56971

We filed a civil action against the County of San Diego for the failure to issue the client a concealed weapons permit. The 9th Circuit Court of Appeals held that San Diego (and by inference, the State of California) had encroached upon the 2nd amendment right to bear arms and reversed the ruling of the Federal Court for the Southern District of California..

Petrus v. DMV, 194 Cal.App.4th 1240

Violation of Due Process by California DMV, lower court ruling overturned and fees/costs paid by DMV to my Client.

Gikas v. Zolin, 6 Cal.4th 841

Petition for review after the Court of Appeal reversed the judgment in an action for administrative mandamus. This case concerns the effect to be given criminal court rulings suppressing evidence pertaining to and dismissing a charge of driving with 0.08% blood alcohol at an administrative proceeding concerning suspension of the defendant’s driver’s license. (Veh. Code section 13353.2.) I did the Amicus opinion.

Arthur v. DMV, 184 Cal.App.4th 1199

Litigating the validity of a DUI checkpoint where there is little indicia of it being an official roadblock.

Please describe a case in the last year or two where you made a big difference.

Edward Peruta, et al v. County of San Diego, largest 2nd Amendment case since Heller, on its' way to SCOTUS. Seeking to allow the 2nd Amendment application outside of the home.

How did you build a successful practice?

Returning all of my phone calls the day that they come in, treating all of my clients the same way that I would like to be treated and dressing as I would expect my own attorney to dress.

What should clients look for in a lawyer?

Reputation, accomplishment and the ability to communicate clearly.

How important is local knowledge to the success of your cases?

Knowing the people that you are dealing with day to day, prosecutors, Judges, Probation Officers allows you to tailor your case to the other Criminal Justice participants and maximize results.

What information can you provide in a free phone consultation?

I have the ability to answer all of the clients questions but to provide a clear strategy going forward with expected results I need an in-person conference.

What information do you need in a free phone consultation?

To make the phone conference more productive I really need a copy of the court/bail paperwork prior to the phone conference so that I can have it reviewed prior to getting on the phone.

What differentiates you from other lawyers in your community?

My results in sentencings, Writs and Motions speak for themselves. I am a resource for the local legal community, speaking for different organizations and nation wide continuing legal education providers.

What is the most rewarding aspect of your job?

Making my clients very happy with the decision that they made to engage my services.

What are your other interests in addition to law?

I am an avid outdoors-man and cattle rancher spending time in Central Oregon.
