Professional Experience:
Richard T. Petesch has represented school districts and other taxing bodies throughout Illinois since 1983, with an emphasis on litigation. He has significant experience in student disciplinary matters, the defense of employment discrimination claims, tax increment financing (TIF) districts, the acquisition, disposition, leasing and construction of facilities and the requirements of public bidding. Mr. Petesch has primary responsibility for Whitt Law’s litigation-related matters. He also serves as a hearing officer in student disciplinary matters.
Mr. Petesch has substantial experience in the prosecution of eminent domain proceedings on behalf of local governments and the defense of those proceedings on behalf of individuals.
On only two occasions, Illinois courts have totally invalidated TIF districts as being ineligible under the Tax Increment Allocation Redevelopment Act. In both instances, Mr. Petesch represented the taxing bodies who successfully challenged the TIF districts.
Mr. Petesch also volunteers as a pro-bono attorney on behalf of CASA Kane County.
