About Richard
Richard Yarmel is a partner and director of the Rochester and Western New York Health Law Practice of Abrams, Fensterman, Fensterman, Eisman, Greenberg, Formato & Einiger, LLP.
Prior to joining the firm, Mr. Yarmel was a partner with Nixon Peabody LLP, where he established a strong practice in health care law. Richard Yarmel advises a broad range of health care providers in Federal (OIG and DOJ), State (MFCU and OMIG), and Joint Commission and other accrediting body surveys, audits and investigations; Medicare and Medicaid voluntary self-disclosures; corporate compliance; Corporate Integrity Agreements; fraud and abuse issues; electronic health information exchanges; HIPAA; residency training program accreditation; patient-related issues; medical staff issues; professional licensure and misconduct; psychiatric commitment issues; discharge planning; guardianships; and many other medical/legal and regulatory issues.
Mr. Yarmel served with the United States Department of Health and Human Services, Office of the General Counsel and Office of the Regional Attorneys. Additionally, Mr. Yarmel was employed by the New York State Department of Mental Hygiene, and by the Hospital Association of New York State, Division of Management and Planning Services.
Mr. Yarmel has lectured at health care provider symposia on medical/legal issues including the Federal and State False Claims Acts, corporate compliance, government investigations, HIPAA, advance directives (DNR, health care proxy, etc.), national practitioner data bank, impaired physicians and practitioners, medical staff credentialing, patient restraints, designated representatives, admission agreements, guardianships, EMTALA, home health agency health and safety standards, patient rights/patient care, discharge planning, nursing home PPS and consolidated billing, and residency training program accreditation.
He received a J.D. from DePaul University College of Law and a B.A., cum laude, from the State University of New York at Buffalo. Mr. Yarmel is admitted to practice in New York and Connecticut. Mr. Yarmel has been appointed Chair of the Special Committee on Long Term Care of the New York State Bar Association's Health Law Section. He has also been appointed by the New York Association of Homes & Services for the Aging to its Legal Services Committee. Mr. Yarmel is a member of the Home Care Association of New York State, Inc.; the New York Association of Homes & Services for the Aging; the New York State Bar Association (Health Law Section, Committee on Fraud, Abuse and Compliance, Special Committee on Long Term Care, and Committee on Ethical Issues in the Provision of Health Care); and the Healthcare Financial Management Association, Board of Directors, Rochester Regional Chapter and Healthcare Compliance Forum.
