But no settlements are ever negotiated without the client's full awareness of the advantages and disadvantages of even undertaking the negotiation, let alone making or accepting a specific demand or offer. Most courts require all litigants to participate in mediation to attempt to reach a settlement, but court ordered mediation with the client's participation can never compel a client to settle if he or she wishes otherwise.
