Questions & Answers

Please describe a case in the last year or two where you made a big difference.

There have been several, but the best was probably the lawsuit I brought against the Army for unconstitutional changes made to the regulation governing tattoos (AR 670-1). That policy specifically targeted active duty enlisted soldiers and discriminated against them in their quest to seek commissioning as officers or appointment to be warrant officers due to the presence of tattoos. This policy directly impacted current special forces soldiers, who are the most likely to have had offending tattoos. Weeks after tendering their answer to the suit, the Army changed the policy back to where it had been and fired the Sergeant Major of the Army, who was responsible for it. Now I still get emails from affected soldiers thanking me for what I did so that they can advance their careers as officers and warrant officers.

How did you build a successful practice?

I suppose that depends on how you define "successful." I don't have the best business sense because I love helping people, especially those whose cases seem the most hopeless. In that way, I have been extremely successful getting people the relief they both needs and want.

What should clients look for in a lawyer?

Honesty. You need to hire someone who can admit that they may not have all of the answers and can be honest with you about reasonable expectations related to your case. You should never go for someone who doesn't appear to be really listening during a consultation and is focused more on what the rate is than trying to solve your problem.

How important is local knowledge to the success of your cases?

Very. As a Commonwealth, every county handles everything differently. It is always beneficial to know the local rules and also the ruling habits of the judges.

What information can you provide in a free phone consultation?

Everything necessary. I can answer whether or not you have a case and whether it is worth your while to proceed. The pros and cons of litigating; whether alternative dispute resolutions are possible; how to structure and build business; what things you need immediately and what things can wait. My phone consultations are extremely informative.

What information do you need in a free phone consultation?

General legal issue; factual background; attempts at resolution (if any); goals for the future.

What differentiates you from other lawyers in your community?

I care..perhaps too much. I don't see people as invoices that have been paid or not; nor do I see them entirely as legal problems to be solved. I see people and do the best that I can to help them; whether my help is entirely rooted in the law or in just being a good listener and helping them work through other problems related to the legal issue they are facing

What is the most rewarding aspect of your job?

Winning and getting people the relief they are seeking. This is especially rewarding when the adverse party is a jerk.

What are your other interests in addition to law?

Charity work; downhill skiing; hiking and camping; horses and travel

Are you involved in your community?

Yes, I try to be and am President and COO of a local charity that uses non-repurposable thoroughbred racehorses as therapy animals for combat veterans of the War on Terror.
