However, Mr. Nalley is perhaps most experienced in successfully litigating cases for unpaid wages, and overtime wages pursuant to the Fair Labor Standards Act of 1938 ("FLSA"), and its state law counterpart, the Illinois Minimum Wage Law ("IMWL").  Both statutes generally require employers to pay their employees for every hour worked above 40 in a particular week their regular pay plus an additional one half of whatever their regular rate is.  If you are working over 40 hours a week and not receiving time and half for your extra hours, or if you are otherwise not being compensated lawfully for work performed, you might be entitled to over time compensation, back wages, liquidated damages (employees, as general rule, are awarded double the amount of their unpaid wages), as well as well as other remedies.  This may be so despite what your employer or company handbook states, and despite the title and job description given to you.  See the section on Unpaid Overtime Wages for more detailed information on this topic.

Mr. Nalley frequently represents victims of violations of the Family Medical Leave Act of 1993 ("FMLA"), which provides most employees with the right to take up to 12 weeks off work to either care for a family members medical condition, or the employee's own medical condition.  The term "serious medical condition" is very loosely defined, and thus, the Act, like the FLSA, is frequently violated.  Also like the FLSA, the Act allows for liquidated (in the form of double damages) for all past and future lost wages.  See the section on Family Medical Leave for more detailed information on this topic.
