Appellant: Attorney for the appellant, Theresa St. Julien. The plaintiff was allegedly injured when her neighbor's dog knocked her down after comiing onto her property. The dog was owned by the defendant, Julie Walters Landry. Julien sued Landry arguing that negligence on the part of the defendant resulted in her injuries. Landy countered with the fact that she was not the legal owner of the dog and therefor was not at fault for the injuries sustained by Newton. Landry moved for a summary judgment based on this information. The motion was granted and Julien subsequently appealed. Upon review of the evidence presented, the appeals court finds that the court erred in the decision both finding that Landry was not responsible for the dog and granting a summary judgement in her favor. The found that the judgment was inappropriate as their remained genuine issues of material fact in dispute that needed to be resolved before handing down a decision. For this reason the appeals court reversed the original decision and remanded the case for further proceedings.
