A native of Lexington, Kentucky, Mr. McCauley is the owner of the Law Offices of Steven M. McCauley, a civil litigation firm located in downtown Lexington.  Prior to striking out on my own, I was an attorney with Charles C. Mihalek, PSC for nearly 20 years.  I have represented hundreds of aggrieved investors in disputes against securities broker-dealers, banks, registered investment advisors, and the financial advisors employed thereby. Mr. McCauley graduated from the University of Kentucky in 1987 and received his law degree (J.D.) from the University of Kentucky, College of Lawin 1990. He also holds an MBA in Finance which he received (with distinction)from the University of Kentucky College of Business and Economics in 1992. Mr.McCauley is admitted to practice in all courts of the Commonwealth of Kentucky, the U.S. Supreme Court, the Sixth Circuit Court of Appeals, and the United States District Courts in the Western and Eastern Districts of Kentucky. Mr.McCauley serves as both an Arbitrator and Panel Chairperson for the FinancialIndustry Regulatory Authority (FINRA) Office of Dispute Resolution.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

I litigated a securities arbitration case against a national broker-dealer, its registered representative, and its control persons for a senior citizens who retirement account was nearly wiped out with speculative, risky and unsuitable transaction. The matter ultimately settled for nearly all of the losses suffered.

How did you build a successful practice?

Primarily by attending to all details and communicating with my clients honestly and frequently. The client's interest must always come before my own and I ensure this in every aspect of my law practice.

What should clients look for in a lawyer?

Experience is the most important asset for an attorney. Specifically, the lawyer must be experienced in the area of law which best suits the clients needs. I have over thirty years of experience in securities litigation and arbitration, auto accident cases, estate planning and probate matters and business litigations.

How important is local knowledge to the success of your cases?

It depends on the type of case. For a matter in state or federal court, local rules and knowledge are extremely important. In FINRA Arbitrations, knowledge of the FINRA Code of Arbitration is a must, but it enforced throughout the United States and its territories, so local practice rules are not as important. However, in FINRA Arbitration, knowledge of the local arbitrators is very important.

What information can you provide in a free phone consultation?

All matters relevant to whether or not a potential client has a viable case, including whether liability exists, damages suffered, the types of damages available, statutes of limitations and other defenses such as comparable fault, failure to mitigate damages and the like. During an initial consultation, both the client and attorney should know whether one or more cause of action exists and what potential damages have occurred.

What information do you need in a free phone consultation?

All the pertinent information about the client and the facts and circumstances surrounding the underlying complaint. It is also helpful to ascertain what if any client expectations exist. Happy clients are good clients.

What differentiates you from other lawyers in your community?

In addition to my law degree, I have an MBA in finance with distinction. I have over 30 years of experience litigating in state and federal courts and in FINRA Arbitrations in Kentucky, Florida, Arizona, Texas, California and several other states.

What is the most rewarding aspect of your job?

Helping people recover money for injuries that they did not cause (personal injury cases) and for financial losses caused by stockbrokers, financial advisors, registered representative and broker-dealers and their agents.

What are your other interests in addition to law?

My other interests include travelling, fishing, golfing, watching sports, reading, cooking and eating. I enjoy spending time with my family at the beach, in the mountains or just relaxing at home in Lexington, KY.

Are you involved in your community?

I spent several years coaching youth baseball (Cal Ripken) and served on the board of the South Lexington Cal Ripken Baseball League. I am actively involved in my church and spent three terms on the Parish Council and Finance Committees.
