About Timothy

Tim Bechtold grew up on a dairy farm near Cold Spring, Minnesota, and graduated from St. John’s Prep School in Collegeville, Minnesota, before getting his undergraduate degree in biology from Harvard College in Cambridge, Massachusetts. Tim spent a post-graduate year in Munich, Germany on a Rotary International Fellowship, then earned an MS in Environmental Studies at the University of Montana, followed by a JD with high honors from the University of Montana in 2000.

After law school, Tim served as a law clerk to the Hon. Donald W. Molloy, Chief United States District Judge for the District of Montana. Tim entered private practice in 2002 as an associate with the Missoula law firm Rossbach Brennan, PC, which became Rossbach Hart Bechtold, PC in 2003.

In 2008, Tim established a solo practice in Missoula as the Bechtold Law Firm, PLLC. The focus areas of Tim’s practice are environmental and toxic tort cases, as well as faulty products, personal injuries caused by negligent acts, and select areas of constitutional law. While most of Tim’s cases are based in Montana, he has litigated cases in California, Oregon, Washington, Alaska, Utah, Colorado, Idaho, Kentucky, Pennsylvania, and the District of Columbia.

Tim is admitted to practice in state and federal court in Montana, as well as the Second, Third, Sixth, Ninth, Tenth, and DC federal courts of appeal. He is a member of the Montana Trial Lawyers Association, American Association for Justice, Public Justice, the Federal Bar Association, and the National Trial Lawyers: Top 100 Trial Lawyers. He has served on the board of directors of the Montana Trial Lawyers Association for over a decade and is a Past President of the Montana Trial Lawyers Association. Tim serves on the amicus committee and the editorial board of Trial Trends, the magazine of the Montana Trial Lawyers Association. He was president of the Montana Chapter of the Federal Bar Association from 2010-2012, chair of the Federal Practice Section of the Montana State Bar 2004-2012, and member of the Rules Committee for the federal District of Montana 2001-2006. Tim is rated AV-Preeminent by the Martindale-Hubbell peer-review ratings and is a Life Fellow of the American Bar Foundation.

Tim is active in community organizations in Missoula. He currently serves on the Board of Directors for Friends of Missoula Parks, Brennan’s Wave, Montana Law PAC, and the Harvard Club of Montana. Tim was Chair of the Missoula City Park Board from 1999-2011, and has also served on the Boards of many community organizations, including the Missoula Area Youth Hockey Association, Missoula Lacrosse, Montana Lacrosse, the Wild Rockies Field Institute, Sussex School, Missoula Bike, the Society for Conservation GIS, and the Montana Bicycle Racing Association. The Bechtold Law Firm sponsors recreational and competitive hockey teams, lacrosse teams, and bicycle racing in Montana.

Tim and his spouse Karen have two adult children, Stellan and Bente. The family enjoys skiing, backpacking, mountaineering, boating, fishing, biking, hockey, gardening, and other outdoor pursuits. Tim’s mom grew up on a ranch near Nashua, in Valley County, Montana, and Tim has numerous relatives scattered across Montana.

Cases

Flanagan v. Chrysler, LLC, CV-09-09-M-DWM (D. Mont.)

Tim and fellow Missoula attorney Chris Froines filed this nationwide class action lawsuit against Chrysler on behalf of all people who had purchased or leased a 2007 or 2008 Dodge diesel truck with a 6.7 liter engine. The 2007 and 2008 model year trucks had numerous engine failures caused by a defective diesel particulate filter that caused multiple engine stalling. After the case was filed, Chrysler declared bankruptcy and Chrysler’s liabilities in bankruptcy were transferred to a proxy company and extinguished. Chrysler emerged from bankruptcy as a new company and began to manufacture vehicles again. Unfortunately for all owners of 2007 and 2008 Dodge trucks, Congress and the President specifically foreclosed all claims against Chrysler.

Gebauer v. VW Group of America, Inc., CV-16-02-M-DLC (D. Mont.)

Tim and Billings attorney John Heenan represented over 400 VW “clean diesel” car owners in what turned into a large national class action, where the Montana VW owners’ lawsuit was combined into a “Multi-District Litigation” with other similar lawsuits all over the United States. VW admitted that it had fraudulently rigged its diesel vehicles to pass emissions tests, when the vehicles actually polluted well in excess of emissions standards when in actual normal driving. A class-wide settlement was eventually negotiated wherein car owners had the option to “fix” their vehicles to conform to emission standards, or accept a cash payment and return their vehicles to VW.

Crismore v. RMS, DV-06-397C (Gallatin County)

Dan Crismore, an experienced bow hunter, was hunting deer from a tree stand when the tree stand failed and Crismore’s safety harness also failed. Crismore fell to the ground and severely injured his back and arm and was left was permanent injuries. The safety harness had no indication of the company that manufactured it, but Crismore had purchased the harness at RMS. After more than a year of research, Tim determined that the manufacturer of the safety harness had been manufactured by BuckWing, which initially denied being the manufacturer. Tim hired a metallurgical expert who determined that a metal clamp holding the safety strap together was not capable of sustaining the pressure expected in a fall. The case settled prior to trial for a confidential amount.
