Appellant: Attorney for the appellant, Brad Taylor of D/B/A? Taylor System of Houston. Taylor appeals the summary judgement granted by the district courts in favor the defendant-appellee, Travelers Insurance Company. Taylor was hired to repair car exteriors damaged while parked outside of the Case plant. The cars needed to have ferrous oxide removed. Taylor completed the job but some of the cars were damaged in the process. Case sued Taylor for damages. Taylor requested that Travelers defend him in the lawsuit as part of the liability insurance policy he had with them for his garage. Travelers refused to defend him and Taylor sued. Upon review of his policy the district court found that the Traveler's was not responsible for representing him or for recovering the income loss he suffered from having to pay case for damages. The appeals court review all the information and found that the district courts had not erred in their decision. The judgement was affirmed.
