Description: County attempted to impose special assessments on all lands within the watershed at flat rate per acre. We argued that assessments could only be levied when land was improved by a public works project. State ex rel Swan Lake Area Wildlife Association v. County of Nicollet and Minnesota DNR 771 N.W. 2d 529 (Minn. App. 2009) Practice Area:Environmental and Natural Resources Date:Sep 01, 2009 Outcome:Successful. Court ruled that County violated environmental law and court could establish lake water levels. Description: Our client, the Swan Lake Area Wildlife Association, sued the County under the Environmental Rights Act for draining two large lakes that provided high quality waterfowl use. County argued it did nothing wrong. After a three day trial, court concluded there was no will and estate should be distributed by the law of intestacy. Description: Wife of deceased entrepreneur claimed that he had written a will that gave her his entire estate and left nothing to his children by a former marriage. My clients were the children and they denied that their father excluded them from his estate.
