Attorney for the Appellant in which said Appellant asserted that the trial court abused its discretion in dismissing the Plaintiff's action regarding a fraud case. The Appeals court agreed with the Appellant and reversed the initial decision.
CLAURO ENTER. V. GALIANO HOLDINGS
Appellant: Attorney for the appellants, Clauro Enterprises Inc. and Ricardo Rupich. The appellants appeal an order denying third motion to vacate a final judgement for lack of jurisdiction in favor of the Appellee, Aragon Galiano Holdings LLC. Upon review of the case the courts dismissed the appeal as to Clauro and affirmed the original judgment. As for Rupcich, the court agreed that service on him was defective and they therefor reversed the original judgment and remanded it for further proceedings.
