MC-10-1435

Practice Area: Criminal defense Date: Nov 13, 2013 Outcome: Judge granted the post conviction and guilty plea was set aside. Description: LPR married to USC wife and one USC child born to them. Cient was convicted of DOV3rd and the N-400 application for citizenship triggered that he was a CIMT offender and ICE picked him up and reffered to immigration court for deportation. Filed a post conviction rule 32 based on Padilla vs. Kentucky. Guilty plea was set aside and later client plead to a disorderly conduct. Client was released from Oakdale and he is eligible to become citizen capable of showing GMC.

ZATARAIN v. BROWN

Plaintiff: Attorney for the plaintiff, Carlos Zatarain in his suit against the defendant, Rickey Brown Mechanic Shop. The plaintiff alleges that the Brown's illegally acquired his truck and knew that he was the lawful owner of the vehicle. They treated the truck as an abandoned vehicle and proceeded to sell it and perform unauthorized repairs. Based on the evidence presented to the court and continued disregard of the defendant for the judicial process, the court finds in favor of the plaintiff.
