Cases

City of Miami v. Wellman

This was a class action suit I brought against the City of Miami on behalf of all people whose vehicles were impounded pursuant to an unconstitutional scheme by the City. The case took 12 years to go through the trip court, the 3rd DCA, the Supreme Court, the 3rd DCA a second time and back to the trial court. Every person who could document their claim got 100% of their money back!

LAT v. State, 650 So. 2d 214 (Fla. Dist. Ct. App. 1995)

Important first amendment case concerning criminal defendants. I was the trial lawyer in this matter.

Gray v. Kohl

568 F.Supp.2d 1378 (2008) With several other lawyers, we attacked an unconstitutional Florida Statute that interfered with freedom of religious expresso. I am very proud to have been part of this legal team!

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

A. I received a phone call from a man who lives in Virginia, who discovered there was a warrant from a crime that allegedly happened over 20 years ago. No one would release any information to him, because there was an arrest warrant outstanding. I was able to open the case, confer with the prosecutors, get the case onto the court's docket and get the long-pending charges dismissed. B. I received a call from a client who has a fairly common Latino name, who said the FBI had issued an order preventing him from lawfully buying a firearm due to outstanding warrants in Connecticut and California. The man had never been to Connecticut or California. I had the man fingerprinted and sent official copies of the fingerprints to the authorities who had the outstanding warrants. It took several phone calls and letters, but eventually, both agencies admitted that my ""Jose Garcia"" with a date of birth of ""03/04/1974"" was not the same person sought by their warrants. With certified letters from the agencies to the FBI, I was able to clear up the interstate mis-identification nightmare. This was a case where my involvement on the client's behalf made a big difference.

How did you build a successful practice?

My practice has grown and continues to grow because my clients refer their friends and family members to me. There is nothing like a happy client when it comes to generating new sources of business.

What should clients look for in a lawyer?

Clients should look for a lawyer who is willing to listen to them, really dig into the details and who is willing to spend the time needed to solve their problems.

How important is local knowledge to the success of your cases?

It is hard to overstate the value of knowing the members of the legal community and having good relationships with them. I have been a trial lawyer in my community for over 32 years. I know the people in my community and they know me. It is an excellent boost to one's chances if the folks know your lawyer and have learned your lawyer is a trustworthy member of the legal community.

What information can you provide in a free phone consultation?

Generally, I can determine whether I can help someone during the course of an initial, free telephone conference. I can let them know if their case is one I can help them with; and, I can inform them before what court or agency their case needs to be brought, and, perhaps, whether they are eligible for the relief they are looking to obtain.

What information do you need in a free phone consultation?

Well, generally, as much as possible. I need to know what the client wants and/or needs. I need to know whether the client needs help getting out of custody on bond; if their case is local or not; whether they have a felony, misdemeanor or other type of case. I need to know if they have been sued, and when they were served with their law suit papers; or, if they are ready to sue someone else. It would also be helpful to know if the prospective client is prepared to press forward with their case. It's helpful to know if the potential client is prepared to hire a lawyer and if they expect to be able to pay their own lawyer's fees or if the are hoping someone else will be paying their bill.

What differentiates you from other lawyers in your community?

I have a well-earned reputation for honestly and successfully handling people's matters for reasonable fees.

What is the most rewarding aspect of your job?

Seeing the faces of the people I have helped after their problems have been successfully addressed and having them tell me that they will be sending their friends and family members to me is the most rewarding aspect of my job!

What are your other interests in addition to law?

I am a member of the faith-based community. I love to work on old cars and to build things. I love to cook for my family and friends.
