Born and raised in Austintown, Ohio, Damian received his undergraduate degree from Bowling Green State University before earning his law degree from the Cleveland-Marshall College of Law in Cleveland, Ohio. Since 1996, after serving a year as an Assistant Mahoning County Prosecutor, Damian began Billak Law, specializing in criminal defense and OVI/DUI defense, where he has successfully tried numerous jury trials in State and Federal Courts in Ohio.

Drugged Driving in Ohio
When people hear the words “driving while under the influence” the first thought is usually alcohol.
Although alcohol related OVI arrests far out number driving while drugged arrests, driving while drugged cases are becoming increasingly more prevalant.
Ohio police officers are now being trained specifically to attempt to detect whether someone is driving while under the influence of a controlled substance, even if the drugs are legal and/or prescribed.
Detection of specific drugs (amphetamines, heroin, marijuana, LSD and cocaine) above a certain threshold detected by a blood or urine test will result in an OVI arrest.
If the alleged impairment is due to prescribed medication, you can still be charged with an OVI offense.
