Questions & Answers
Please describe a case in the last year or two where you made a big difference.
In August of 2014, I forced a substantial settlement from a 2008 St. Charles County judgment. After years of attempting to locate the debtor, the judgment creditor hired my firm, and I utilized my collection software and private investigators locating him in Southern Illinois. After registering the judgment in Illinois, I conducted an eight (8) hour examination of the judgment debtor under oath in open court, in which I uncovered numerous fraudulent transfers into an Illinois land trust. My office then filed multiple post-judgment complaints, seeking to have the fraudulent transfers set aside, and obtaining an order from the court freezing all of the trust's assets. Left with no cash flow and no way to operate his business, the judgment debtor's attorney and I sat down over a two-day period and worked out a settlement that more than satisfied my client.
What should clients look for in a lawyer?
When looking for a lawyer, it is important to meet with them to determine if they are easy to talk to, if they are willing to work with you regarding payment, and whether their office appears to be functioning efficiently. An attorney should be easy accessible. I give ALL of my clients my personal cell phone number, and encourage them to call or e-mail any time, day or night.
How important is local knowledge to the success of your cases?
Each courthouse is different. Each judge is different. Each court clerk is different. It cannot be stressed enough how important it is to hire an attorney who is familiar with the procedural rules of the court in which potential litigation will be filed. If the attorney isn't familiar with the tendencies of a particular Judge, you can bet he knows another local attorney who does. I've traveled to small town courthouses on many occasions and immediately feel at a disadvantage when I walk into a trial against a local attorney.
What information can you provide in a free phone consultation?
A phone consultation can be an efficient way of determining whether you have a case, what your options may be, and how the local rules and laws apply to your situation.
What information do you need in a free phone consultation?
In order for a phone consultation to be effective, it is important that all of the facts be organized and conveyed in an efficient manner. If there is documentation supporting your claim, it is important to have that information in front of you, as we will need the name of the opposing party and all information you have regarding their whereabouts and financial situation.
Are you involved in your community?
I am heavily involved in my neighborhood organization and various local legal organizations. I am past President of Shaw Neighborhood Improvement Association (SNIA). I am currently a member of multiple solo and small law firm groups, including a "Meetup Group" and the Bar Association of Missouri St. Louis. The unrest in Ferguson, Missouri has affected my neighborhood directly, and is more important now than ever for our residents to stay actively involved.
