I sold a house and the buyer retained this law firm. One lawyer at this address was the closing attorney while another was the title attorney for the lender. The communication coming out of these lawyers was next to nothing. The day before the closing, my attorney was notified that there were six (6) mortgages on my house that had not been properly discharged by prior attorneys (a result of dropping rates and refi's). They then mandated that they withold $48,000 in proceeds from the closing. This was to "motivate" the seller (me) to have the mortgages properly discharged or the closing would not go through as scheduled. This put a huge strain on my attorney and his team and a financial hardship on me. Five weeks after they recieved confirmation that the mortgages were properly discharged they still had not returned my $48,000 nor would they provide a reason why to my attorney. Upon visiting their office they informed me that the lack of payment was based on their practice of allowing the buyer to verbally approve the release of my funds and they hadn't heard from the buyers attorney?? What they didn't know is 1. I knew that the buyers attorney shared an office with the title attorney and 2. that I was communicating with the buyer and the buyer stated that no one had ever asked him for his approval. To my knowledge (nor to any other lawyer that I spoke to) there is no legal precedent for a buyer to approve the release of funds to a seller. I was informed by a third party lawyer that this was an untrue statement. Second, they claimed the buyer was holding up the funds when, in fact, the buyer had no knowledge of the situation. This, I know, first hand to be an untrue statement. Once it was clear that I was aware of all of this, I had my check in 2 hours. Knowledge is power. Know you have knowledge regarding how the attorney's associated with this law firm conduct themselves and you can make your own decision.
