I have had the opportunity to meet and practice with many lawyers in my 40 years in the law business. I recently had a case with David Pierce. He and his law firm are a first class organization. I observed him in trial and also settle a case that provided his clients exceptional value. As a result, I found myself extremely impressed. Errors and billing issues. There is no trolling. There were errors made in filings that are public information and David tried to charge us to fix his errors on the federal rules. Outsmarted by opposing attorney that led in our case not getting proper discovery...Attorney Pierce did not get the terms in writing...maybe good intentions, but this is law and the court gave no reprieve. Instead of taking the criticism to the errors as points of improvement, he filed a note to the court behind his client’s back in order to harm the case as he was being fired. The court obviously struck down the writing, but that is the opposite of fiduciary responsibility. He absolutely tried to hold files until pressure was applied. Any additional denials and i’m happy to share details here. I don’t feel the need to go there, but will to warn anyone that has a significant business case in federal court. Maybe he’s fine with small cases, but he dropped the ball , had no urgency to improve, and tried to bill us to fix his errors. This was a serious business case not some paper filing excuse to make a buck on some hours. Took no ownership over the work product and was given every opportunity to fix...i thought he was a decent guy actually. Cal Bar Association recommended we take him to fed arbitration. The “we are being trolled” is more misinformation. You can review most of this in the federal court docket. It just depends on how serious your issue is, i would not recommend for 6 figure + cases as a business owner.

This firm is ethical, they clearly show compassion, they actively listen and understand, and they can put themselves in your shoes. Dave Pierce is nothing like all the typical stereotypes you hear about lawyers, he is the very opposite. His entire team is customer service oriented.

Team is misrepresented, doesn't actually have paralegals. Made several mistakes in the process...tried to fix them without telling me ON MY DIME. Was consistently the least sharp lawyer in the room. "Creative" billing...and had to take some things back when caught. NOTES FROM LEGAL AUDIT FIRM: OVER-BILLED 94 Hours! Legal Billing Adjusters s an attorney fee auditing and consulting service. We were retained by your former client, to review legal bills generated by your firm between March 12, 2019 and January 31, 2020. Below is a summary of our review and analysis of your billing as well as our demand for a prompt refund. Our work comprised of a thorough analysis of your firm’s credentials, the Court’s file (xx), your firm’s e-mail correspondence, and SEA’s telephone records. Additionally, we familiarized ourselves with applicable California case law and ethics rules, in particular CRPC Rule 4-200. After considering the ladder, we confidently determined that your office over litigated this case and therefore over-billed SEA 94.3 hours, totaling $37,720.00. California law is clear, an attorney’s fee must be reasonable and commensurate with the level of difficulty of the work performed. Reasonable compensation does not include compensation for “padding” in the form of inefficient or duplicate efforts. Ketchum v. Moses, (1010) 24 Cal.4th 1122, 1131-1132. A reduced attorney fee should be justified by a general observation that an attorney over-litigated a case or submitted a padded bill. Gorman v. Tassajara Development Corp., (2009) 178 Cal. App. 4th, 44. Furthermore, passively representing where only limited success is achieved also warrants a reduction in an attorney’s fee. Sokolow v. County of San Mateo, (1989) 213 Cal. App. 3d 231, 249. Between March 12, 2019 and January 17, 2020 your office managed to bill 211.6 hours. Out of this extraordinary time 86.9 hours (41%) was spend “reviewing” but not analyzing items, mostly generic correspondence. Your office spent 15% of the over-all time (32.8 hours) on phone calls and 6.1 hours on legal research of routine legal principles. In fact, your office billed 108.2 hours before the Answer was filed on or about August 1, 2019, State bar - "Errors arising out of do not necessarily constitute unethical conduct. Again, while this conduct may be evidence of negligence or malpractice, without more, it does not demonstrate evidence that Mr. Pierce has committed an ethical violation." is directly for the LA Bar association. Translation - he sucked, but its not clear that it was on purpose therefore an ethical violation...but may be evidence or NEGLIGENCE OR MALPRACTICE. Basically doing the absolute minimum and a bad job(as long as its not on purpose) is not malpractice. I guess my"bar" was higher. However, I was referred to fee arbitration and asked about another document (he submitted a document that actually would have HURT my case without my approval, but was stricken by the judge) * Errors(as I referred to above). * Never cared about issues until called out. Other lawyers told me about errors...that this man tried to charge us to fix it without even telling me what happened. * struggles with local rules for California federal *Outsmarted by opposing...and tricked out of securing deposition making(what he thought was) verbal agreements with opposing...on a major federal case. * Limited resources (types/works slow and no paralegal or junior more technologically savvy lawyers to get stuff done). Billed admin work at his "partner rate"...terrible cost structure *Disorganized and doesn't use simple technology for efficiency I just needed someone competent locally for a case that was moved and this guy was unwilling to work hard or admit that this was out of his league...but was focused on collecting money! Small cases maybe he can't mess up, but I would investigate if we are talking significant $$$. This was certainly a learning experience. Shady lawyers have consequences.
