Mark Knop drafted an Enforcement and Fining Policy for our homeowners' association that contains an overly broad summary that essentially has all homeowners in violation on a nearly constant basis. Specifically, there is a statement that trash cans can only be put out on collection day (not the night before collection) as well as a statement that commercial vehicles may never be parked on the public streets or in the driveway, even temporarily. While some may think I am nitpicking the wording, lawyers are trained to be precise in their language and held to a much higher standard than the folks reading and trying to follow this policy. And if anyone should think that I am criticizing the words and ignoring the intent of the policy, and that the board would not enforce such blatantly impossible situations, I'm holding a "courtesy notice" from the board because a commercial trailer temporarily resided in my driveway overnight loaded with my demolished fence. It was parked from 5:30 p.m. until 4 p.m. the next day when it was removed, yet I received a notice dated the only date it was in the driveway stating I was in violation for having the trailer parked in sight of the street. This review is therefore entirely valid as it is based on actual experience with documents where Mr. Knop is listed as the responsible attorney. The document is poorly drafted and the public should be aware of this short-coming when considering Mr. Knop for their own document drafting.
