Please describe a case in the last year or two where you made a big difference.
My client and I prevailed in a contested custody case at trial based on excellent pre-trial preparation which led to a cross-examination of the opposing party which the court cited as the key to the court's decision to overrule the recommendation of the custody evaluator and award custody to my client. The pre-trial work also led to the court dismissing the opposing parties claims that separate property funds were used to buy the family home and should be reimbursed to the opposing party. That claim was rejected by the court.
How did you build a successful practice?
Hard work, diligence in working cases and responding to clients, honesty in dealing with clients which includes sometimes telling people what they don't want to hear but need to .
What should clients look for in a lawyer?
Firm advocacy, backed up by preparation, responsiveness to the client, which includes realistic expectations and never any guarantees except my hard work.
How important is local knowledge to the success of your cases?
Local knowledge helps. I have been here since 1977 and know almost all the attorneys in Alameda county. I have been in front of all the judges. . Experience and being familiar with the judges is invaluable. The personalities, the court room procedures and expectations vary from attorney to attorney, judge to judge.With one exception (Judge Noel Wise- about 7 times) I have been in front of each judge more than 20 times and with Judge Nixon and Commissioner Alexander- over 200 times.
What information do you need in a free phone consultation?
The basics are names and ages of parties and children. Date of marriage, separation. Health issues for parties, children. Domestic violence allegations. Incomes of parties. Length of employment for each. Restraining orders in effect? If not ever? Existing custody orders/agreements? Debts of parties. Pre-nup? Alcohol or drug issues. Arrests/convictions. Ongoing criminal case? Ongoing juvenile case- prior juvenile case? Has a case been filed-when? Have the parties been to court?-If so how many times, when last, when next.What court? Opposing attorney? Significant grandparent involvement ? Is anyone requesting a move out of state with children? Why?
What is the most rewarding aspect of your job?
Knowing I did the best I could , win or lose and was honest with the client.
