MARTIN v. U.S. EX REL. DEPARTMENT OF HEALTH AND HUMAN SERVICES

Plaintiff: Attorney for the plaintiffs, Cara Martin and Jacob Kennedy. Cara Martin and Jacob Kennedy are the biological parents of R.K. who was born via emergency C-section. During the C-section the doctor accidentally resected the skin on the infant's head and he had to be airlifted to a nearby hospital where he remained for a week. The plaintiffs allege gross negligence by the hospital and it's staff and sought damages for medical expenses, pain and suffering as well as the permanent disfigurement of their child. The defendants motioned for dismissal, their request was denied. It was ordered that the plaintiff's must file an affidavit of merit in support of their negligence claims. Failure to do so would result in a dismissal of their claims. This case is ongoing and was last updated July 26, 2016.
