James R. "Jim" Butler was born and raised in Waco, Texas. He graduated from Baylor University in 1988 with a Bachelor of Arts degree in Political Science , and from South Texas College of Law in 1992 with a Juris Doctor degree. Mr. Butler was licensed to practice law by the Supreme Court of Texas in 1993. During Law School his focus was Criminal Law and Trial Advocacy. After a two year internship with the Harris County District Attorney's Office, Mr. Butler knew that his calling in life wasn't to prosecute people, but to help those in need of defense.

Mr. Butler is a devoted husband and father of two children.

  • State of Texas VS Ruben: Client was pulled over after an officer witnessed him purchasing alcohol & placing it in the front seat. A DWI Task Force officer was called to perform FST’s. After providing a breath sample, he was arrested for DWI. First court date was 1/27/2011 , Mr. Butler did a Motion to Suppress the traffic stop. Client’s case was dismissed State of Texas VS Chanaba: Client was leaving Twin Peaks restaurant, he was speeding, going 75 in a 65 mph zone. He failed FST’s at the scene and refused to provide a breath specimen. We set this case for trial. The Case was dismissed the day of Trial. State of Texas VS Penaflor: Client’s car broke down on the highway. When an officer arrived on the scene, she alleged he was backing up on the Beltway. The client provided a breath sample of .113. This case was dismissed the day before trial State of Texas VS Fredricks: Client was found asleep in his car which was parked on a bridge crossing Braes Bayou in Meyerland, facing the wrong way on a one way street. The Client blew a .079. However, he voluntarily gave a blood specimen which showed recent consumption of opiates and marijuana. The case was dismissed before the trial date. State of Texas VS Duncan: Client was facing a 2nd DWI charge. He hit an off duty police officer from behind. Inside his vehicle, officers found un-prescribed Xanax, and an open container of alcohol. This was a Blood test case that we set for Trial. DWI 2nd dismissed the day of trial. State of Texas VS Malchow: NOT GUILTY after jury trial. Client was pulled over for speeding, 65 in a 35 mph. zone. He admitted to drinking 7 beers at a sports bar. He failed the sobriety tests both at the scene, and at the HPD “intox room”. Client was acquitted after a 3 day jury trial. State of Texas VS Ine: Client blew a 0.13 after being stopped for speeding 60 in a 35. Client failed all FST tests. Case was set for Trial. Mr. Butler filed a motion to suppress based on a prolonged detention. This case was dismissed the day before trial. State of Texas VS Guardia: Felony DWI (3rd) The client’s blood test came back a 0.079. State pursued due to the clients poor performance on the Field Sobriety Tests and the fact that they found a bottle of liquor in the front seat which the client admitted to drinking. State would not dismiss, so we had to set it for Jury Trial. Case was dismissed the day before trial! State of Texas VS Crouch: Client’s vehicle left the roadway and and struck a house at 3 a.m. The client agreed to a breath test which showed that an interferant was present. Officers alleged strong odor of alcohol, bloodshot eyes and slurred speech. Said he failed all sobriety tests. The State wouldn’t back down and we had to set the case for trial. On the Eve of trial date, case DISMISSED. State of Texas VS Cruz: Client pulled over for speeding, officers took him to the BAT van for a breath test where he blew a .14. Client looked great on video. After several months of gathering evidence the case was set for trial, and motions to suppress were filed. State dismissed the trial case the weekend before trial. State of Texas VS Martinez: Client was pulled over after a 911 call was made and the officer saw the defendant fail to maintain a single lane. FST were conducted. Defendant was arrested and blew a .10 in the Intoxilyzer. Day before Trial state DISMISSED. State of Texas VS Solis: NOT GUILTY by Jury Trial State of Texas VS Robertson: Pulled over for speeding, awaited for DWI task force, it is alleged that he failed, took to station to provide breath test (result 0.16) which was twice the legal limit. Case dismissed before trial State of Texas VS Hines: Defendant had a blowout on the freeway, Tow truck driver called 911 saying person was passed out behind the wheel. Officer arrived performed FST, and charged Defendant with his 2nd DWI. Set for Trial – found NOT GUILTY State of Texas VS Rineman: Arrested on No Refusal Weekend after speeding 65 in a 45. Officer performed FST, defendant refused Breath test and had Blood taken by warrant. Set for Trial. The state could not find the blood warrant therefore making it invalid. State DISMISSED State of Texas VS Estrada: Passed out at a redlight for several hours. Passenger was taken to the hospital for possible alcohol poisoning. Did poorly on FST tests, Refused breath or blood sample. Set the case for Trial, dismissed weekend before Monday Trial date. State of Texas VS Perez: Defendant was pulled over by DWI task force officer for speeding. He did poorly on FST and refused all breath and blood tests. State would not dismiss due to defendants statements about all the bars he had been to and being confused about which on e he was at last. State dismissed one week before Trial. State of Texas VS Porter: Parked on a side street on the curb putting an address into GPS when an officer checked on her. Smelt alcohol and performed FST tests. She was arrested and blew a .14 in a handheld breathalyzer and later blew a .09 at the station. After 2 settings we set for trial, before Mr. Butler left the court room the State dismissed the case. State of Texas VS Simmons: Client was pulled over for going the wrong way on the beltway. Client did not do well on FST tests. He refused all Breath tests. Case was set for Trial after more than a year (due to his job overseas) the case was put on a Trial docket and dismissed the Friday before Trial day. State of Texas VS. Soltner: 911 call came in that Defendant was driving drunkn down a street almost striking a mailbox. Defendant failed FST tests, and refused a breath test. Case was ultimately set for trial. DA Dismissed case on State of Texas VS. Ghee: Client struck an 18 wheeler, airbag deployed. Did very poorly on FST tests, blew a 0.16 on the Intoxilyzer. Set the case for Trial. Showed up morning of Trial ready to fight – Case Dismissed!
