Please describe a case in the last year or two where you made a big difference.
My biggest impact cases are those when I am representing someone who is a defendant in a case, whether they are being sued for debt, evicted, foreclosed upon, etc. I take the worry and stress that comes with such a case and allow my clients to live life without constant worry. Oftentimes I can ensure that someone can stay in their home or apartment much longer than they would on their own if they are facing an eviction or foreclosure. I also can either get the debt wiped out or reduced. In a recent eviction case, my client received a three-day notice to move out of her apartment in July of 2019 and she is still in the apartment as of December of 2020 despite the landlord filing an eviction lawsuit against her. What can you do with extra time after receiving an eviction notice?
How did you build a successful practice?
My practice is built upon experience on both sides of the cases I handle, constant learning and teaching, and empathy. I have represented big banks, creditors, debt buyers, etc. I have been able to use that experience to now represent people instead of companies. I am constantly learning and teaching. I am a member of the Texas Bar College, made up of less than 5% of the attorneys in Texas. Membership is offered to only those attorneys who go well beyond the minimum continuing legal education requirements mandated by the State Bar of Texas. In fact, I have been a member for 18 years straight now. I also constantly teach the public and attorneys and their staff about laws, practicing law, and the rules that govern the legal profession. Lastly, I am empathetic. When you come to me, I will not be judgmental but I will be honest and straightforward with you about your case. My clients know that even if I have to give them bad news about their predicament, I will do so in a kind and empathetic way and look for the best possible solution.
What should clients look for in a lawyer?
First, does the lawyer have the expertise in the area of law in which you have a need. Don't come to me for personal injury or trademark law, but come to me for everyday people law, such as consumer rights and family law. Second, does the lawyer have good client reviews on the Internet. If the lawyer has mostly bad reviews or doesn't have reviews, beware. There are websites out there that allow clients to review their attorneys and offer ratings. Luckily, I have been rated as a top lawyer in my practice area for many years now.
How important is local knowledge to the success of your cases?
I practice all over the State of Texas. My principal office is located in Houston, so I know Houston and the surrounding communities the best. I believe local knowledge is important to some extent. However, there are some attorneys who may not have your best interest at heart because they are afraid to rock the boat with the local legal community and judges. I am often called in to other cities and towns because people are unable to find a lawyer willing to take their case at risk of upsetting the local judges. It sometimes helps to bring in an outside lawyer who has no fear of or loyalty to local judges.
What information can you provide in a free phone consultation?
I often provide free telephone consultations that last between 15 and 30 minutes. I can give a quick overview of the law that applies to your case, some suggested strategy and possible outcomes of your case, and help with a cost/benefit analysis of different tactics to take.
What information do you need in a free phone consultation?
I normally need the general facts if a dispute has not risen to a court case yet. If there is a court case already, then I need the case number, court number, and county where the case is located, in addition to the general facts. I cannot do a deep dive into the details of the case, but sometimes I am able to look up the case online while we are talking and comment on what I see about the case.
What differentiates you from other lawyers in your community?
There are very few experienced private consumer lawyers representing consumers. Most attorneys who represent consumers work for either legal aid or the government. I am a member of a national consumer lawyer association that is highly selective and special. I also have years practicing family law as well. I have been a leader of local, state, and national bar associations. I am a regular teacher of other attorneys and their staff and an author of columns and articles. I host a daily video series discussing various laws. More importantly for my clients, I have an online client portal that allows my clients to keep up with their cases 24/7 without having to worry what is going on with their case.
What is the most rewarding aspect of your job?
I love helping people not get run over by big companies, other attorneys, or the system simply because they don't know what to do. I empower people with knowledge and representation so that they can make the best decisions for their particular situations. Oftentimes my clients make too much money to qualify for legal aid but don't have enough to hire big firm attorneys. I focus on that gap and primarily represent people who have some money but are not wealthy or have cases that require an attorney but not an overpriced attorney.
What are your other interests in addition to law?
I love reading, writing, and speaking. I am certified by John Maxwell and Les Brown to teach their materials and love speaking, training, and motivating. I also enjoy walking and bikeriding. I'm looking forward to walking El Camino in the next year or two and doing some overnight bike trips.
Are you involved in your community?
I serve first and thus am highly involved in my community. From leading bar associations to speaking to the public about legal matters, from volunteering at legal clinics to helping out at events, I am constantly giving and helping. I couldn't live any other way.
