Jim Shenwick graduated from the University of Pennsylvania Wharton School Undergraduate Division in 1979, the Boston University Law School of Law in 1982 and the New York University School of Law Graduate Tax Program in 1983. He is admitted to the bar in the State of New York and admitted to practice law in the Southern District of New York and the Eastern District of New York.

He has practiced law for 25 years and has a practice limited to real estate and bankruptcy law.  He is “of counsel” to Littman Krooks (a firm with corporate/securities and elder law practices).

His bankruptcy practice includes both personal and business bankruptcy (representing both debtors and creditors).  He has represented many businesses in chapter 11 cases, represented creditors in filing proofs of claims, defending preference and fraudulent conveyance actions and various creditors in chapter 11 cases.  He has represented many landlords in bankruptcy cases dealing with the issues of the assumption and rejection of leases pursuant to section 365 of the Bankruptcy Code, rejection damages due Landlords when leases are rejected in bankruptcy and motions to compel the payment of rent in chapter 11 cases.  He has represented Landlords or creditors in the Adelphia, Kmart and SGI bankruptcy cases.

His real estate practice includes a specialty in commercial leasing (he has represented over 250 tenants and landlords in commercial lease negotiations).   

Representative Manhattan transactions include the following: (a) representing a Landlord who leased retail space to a Gap store in Midtown East, (b) representing a Landlord who leased space to a coffee chain in the East 20’s, (c) represented a private equity fund that leased office space in 7 Time Square Tower, (d) represented a hedge fund that leased office space at 590 Madison Avenue, (e) represented an Internet social marketing company that leased space on 23rd Street, (f) represented a Landlord in Soho who leased space to a restaurant and food store, (g) represented  an art gallery that moved to the West 26th Street art district and (h) a hair transplant doctor who leased space for an upscale hair transplant facility on Madison Avenue.  He also represented a chain of pizza stores who leased space throughout NYC and Long Island.

He has written on the assignment/subletting of commercial leases, questions tenants need to ask Landlords before signing a commercial lease, “silent” commercial lease issues not dealt with in standard lease forms and hidden costs in commercial leases.  He has given presentations to the American Institute of Certified Public Accountants, the SUNY School of Optometry on office leasing and small business bankruptcy and various bankruptcy issues for the First American Title Insurance Company CLE program.  He spoke at the Association of the Bar of the City of New York on commercial leasing issues for tenants.

He has also given talks on personal and small business bankruptcy to the NYS Society of CPAs.
