Mr. Donner is a trial attorney with broad transactional experience. His professional activities have focused upon commercial litigation involving business disputes, fraud, real estate, and development issues in both NJ and NY State and Federal Courts as well the 2nd, 3rd, and Federal Circuit U. S. Court of Appeals. He has also been engaged in medical malpractice and legal malpractice matters. He has been involved in suits against various government agencies including the Internal Revenue Service, the FDIC, the U.S. Navy (on behalf of government contractors), and various municipalities. He has appeared before a wide range of appellate courts, both state and federal, as well as administrative courts such as the Armed Services Board of Contract Appeals, the U. S. Tax Court, the Federal Court of Claims, and the New Jersey Tax Court. Two of his reported cases, Saffer v. Willoughby and Safer v. Pack, are landmarks in New Jersey jurisprudence, addressing fee recovery against negligent attorneys and physician responsibilities in cases of genetically transmissible disease, and have been cited nationally. Mr. Donner has also appeared on behalf of clients pro hac vice in litigation venues in the Eastern District of Louisiana and the State of Maine.

Additionally, Mr. Donner has been involved in significant real estate and other business transactions throughout his career within New York, New Jersey, and many other parts of the country, including Florida, Texas, and Illinois. Mr. Donner is an excellent draftsman of legal documents and a persuasive advocate in his written submissions. He has also been extensively involved in obtaining development approvals in public hearings for hospitals, a place of worship, an assisted living facility, other distinctive projects as well as site plan and subdivision matters regarding a broad range of projects for developers and national chains.

Safer v. Estate of Pack

291 N.J. Super. 619 (App. Div. 1996) Holding: The surgeon treating plaintiff’s father for a genetically transmissible disease that is always fatal unless timely checked and treated, had the duty to advise that patient’s child and the patient’s siblings that they were at risk for this disease and needed to be routinely checked for its occurrence and timely treated should the disease arise.

Please describe a case in the last year or two where you made a big difference.

I am presently representing the plaintiff in a case in the NJ Federal District Court-Camden vicinage. We are suing a California company for breach of contract seeking millions in damages. I have had to learn the details regarding an industry that few know anything about, and have secured the services of multiple experts. We have taken depositions throughout the country, and have engaged in complex motion practice. We are hoping to try the case before the end of this year.

Through hard work and always placing the interests of my clients first.

How important is local knowledge to the success of your cases?

All knowledge is important, but I value knowledge of the law and the mechanics of being a lawyer as far more important than local connections which can always be developed in the course of the case.

Yes. I am a former president of my congregation, I write occasional articles for a monthly journal published in my community, and for the past 16 years I have presented an Annual Event celebrating the life and work of Dr. Martin Luther King, Jr.
